In Ufa, a pervert took obscene photos of a minor who entered the elevator with him on his phone, which was recorded by a surveillance camera. This incident reminded of the existence of upskirting – secret photography under a skirt or in a decollete without the permission of their owners. “MK” found out under what articles perverts of this kind fall – there were a lot of articles.

It all happened in one of the high-rise buildings in Ufa on Sofia Perovskaya Street. A young man, outwardly unsuspicious, enters the elevator with a girl with a backpack and a scooter. During the trip, she turns to the elevator doors, and suddenly the guy starts taking pictures with the camera of the phone under the girl’s skirt; shoot and look at the photo …

It is reported that the girl noticed what was happening, but she was frightened of the man and did not show it. Only at home she complained to her parents, and they told the police. Several days have passed, but the pervert has not been found, although the guy’s face is clearly visible on the video.

According to sources on the Internet, “upskirt (ing)” (from English upskirt – “raising a skirt”) is a type of public voyeurism (secretly spying on people having sex or intimate processes: undressing, taking a bath, etc.).

In many countries, and Russia is no exception, covert filming is prohibited by law, but in reality, when such cases come up, the offender may not be punished. This happened a few years ago in the US state of Massachusetts, when upskurter Michael Robertson was caught. The court found him innocent, ruling that girls on public transport cannot be naked a priori, and therefore their privacy cannot be violated.

But in Japan, where upskirting is recognized as a huge problem that millions of women suffer from (Japanese schoolgirls in short skirts are the most favorite “objects” of upskirts), on the contrary, they decided to take this phenomenon seriously. In the summer of 2023, it became known about the decision of the country’s authorities to recognize upskirt as a criminal offense and adopt a single law to prosecute secret sex photographers. Violators will face either a fine of up to three million yen or imprisonment of up to three years.

– Taking into account the goals of filming – to cause sexual arousal, here you can raise the issue of illegal production of pornography, – Stalin’s lawyer Gurevich commented on this situation to MK. – Considering that in our case he was filming a minor, I think we can talk about “using a minor for the purpose of making pornographic materials or objects”, this is Article 242.2 of the Criminal Code of the Russian Federation. And in this case, it doesn’t even matter whether he filmed for himself or for further distribution, since we are talking about the illegal production of pornography involving a minor. The term under this article is from three to ten years in prison.

But if the child noticed these actions, realized them, then here, as I think, we can already talk about “lewd acts against the child”, article 135.1 of the Criminal Code of the Russian Federation. We can say that the child was already involved in this process. Here we can draw an analogy with several recent verdicts against exhibitionists, those who like to “open their cloaks” in front of children. If a child sees this action, it means that a crime has been committed.

Further, there is still a violation of privacy, article 137 of the Criminal Code of the Russian Federation. Namely, the illegal collection or dissemination of information about the private life of a person, constituting his personal or family secret, without the consent of the person. I am sure that the underwear that a person wears belongs to his private life. Here, too, it does not matter to what extent such photographs can be attributed to “pornography”, and whether the offender will continue to distribute them.

Do parents have to file a complaint if this happens, or is it enough for the video to get to the police?

– In such cases, firstly, parents can apply to the investigative committee, and, secondly, even if they had not filed, it is obvious here that not only the personal interests of the child are affected, but also public ones. Therefore, the mechanism for identifying the offender with the aim of punishing him can be launched without the parents’ application. Police officers who got this video must write a report on the identified signs of a crime, after which an investigation should begin. Based on its results, the issue of initiating a criminal case is decided. Those who do this are under the delusion that nothing threatens them.

Psychotherapist and sexologist Alexei Lysenko, who studies sexual deviations among other topics, explained the dangers of this perversion:

– Such things – the desire to see the hidden – are characteristic of many men. But for some, such peeping becomes an exciting factor for many years (a voluptuous anchor, there is such a thing in NLP), even when they grow up. Normally, there are many such anchors. But it happens when a man gets hung up on one thing. It becomes a fetish.

There are many options for brazen peeping and secret penetration into someone’s life. This was especially intensified with the advent of mini-cameras. Sometimes voyeurs embed them in their shoes and film women and girls secretly in transport, public places…

Such a brazen and cynical intrusion into someone else’s life is a clear marker of perversion. Not to mention the choice of an object that is obviously not capable of fighting back, as in this case. They deliberately choose them. The child was afraid of him, and he felt it.
