A trip to a pharmacy for residents of Tyumen turned into a prison. As it became known to MK, 37-year-old programmer and father of three children Mikhail Gubin was driving home from a pharmacy that day. The man was impatient in the toilet and not finding a suitable place, he simply stopped the car on the side of the road. There were no playgrounds, no educational institutions, no people nearby. Having relieved himself, the man drove on, but on the same day he ended up in the police for his act.
It turned out that Mikhail was still seen behind a not entirely decent deed. A 10-year-old girl told her mother that she saw “uncle touching himself ‘there'”. The worried mother called the police and reported the incident, and on the same day Mikhail was detained in hot pursuit. The man failed to prove his innocence, the case went to court. Result: 12 years of strict regime.
The defendant’s lawyer appealed to the court of appeal, but there the verdict was upheld. Now a new lawyer, Maxim Kalinov, has joined Mikhail’s case, believing that there are grounds for reviewing and overturning the guilty verdict. According to the defender, the investigation conducted the case with numerous violations.
The girl then said that the man still only went to the toilet and did not commit any indecent acts of a sexual nature. The mother of the child, who tried to withdraw the application, was threatened by the investigation with an appeal to the guardianship authorities. The fact is that on the day of detention, a confession was literally beaten out of my client: he was beaten and forced to confess. Now we have the last resort and I am convinced that the sentence against Mikhail Gubin will be cancelled. Even the girl’s mother herself (the injured party) wrote an appeal with a request to cancel the guilty verdict – this is generally nonsense. Even now, two examinations have been carried out (based on the video recording of the interrogation of Mikhail Gubin and the girl). The examination established that Gubin did not commit this crime. And also that the girl is telling a lie and probably speaks under pressure from adults.
As the defendant’s lawyer added, their side is ready to conduct more than one examination – many, just to prove Gubin’s innocence.
