The Commission on Juvenile Affairs (CDN) of the administration of the city of Efremov in the Tula region filed a lawsuit to restrict the parental rights of a local resident Alexei Moskalev, who was placed under house arrest in the case of discrediting the army (Article 280.3 of the Criminal Code of the Russian Federation). The lawsuit was filed in January, even before the arrest of Aleksey Moskalev. In it, the commission also asks to limit the parental rights of the mother of a sixth-grader, the newspaper reports.
The decision to restrict parental rights under Art. 73 of the Family Code of the Russian Federation, is accepted if the behavior of the parents or one of them is dangerous for the child. If it does not change in six months, the guardianship authorities are required to file a lawsuit for the complete deprivation of parental rights.
According to Svetlana Davydova, the Moskalev family has been “on the preventive list of families in a socially dangerous situation” since May last year. She stated that Mr. Moskalev did not make contact with the authorities, was twice brought to administrative responsibility, and the girl’s mother was not interested in her life and lived separately.
The lawyer of the detainee, Vladimir Bilienko, told RBC that he was not notified of the lawsuit. According to him, the children’s rights ombudsman of the Tula region believes that there are no grounds for such a claim, but its possibility was previously discussed.
A criminal case against Mr. Moskalev was opened at the end of December last year. On March 3, the Ephraim Interdistrict Court sent the man under house arrest, and his daughter was sent to a social rehabilitation center for the duration of the proceedings. On March 3, the KDN decided to leave Maria in the center “in the care of experienced psychologists and teachers,” Svetlana Davydova said.
Mr. Biliyenko told the publication that his client was not limited in parental rights and did not give consent to his daughter’s stay in a social rehabilitation center.
In April last year, Maria Moskaleva, who was then in the sixth grade of the Efremov school No. 9, drew a woman with a child, the flags of Ukraine and the Russian Federation, and flying rockets at an art lesson. The school administration complained to the police, and Masha’s father, according to the lawyer, “began to be examined under a magnifying glass” by employees of the ICR “and other law enforcement organizations.”
On April 25, 2022, the Efremov Interdistrict Court fined the entrepreneur 32,000 rubles. for “public actions aimed at discrediting the use of the Armed Forces of the Russian Federation” (under Part 1 of Article 20.3.3 of the Code of Administrative Offenses) for a comment in Odnoklassniki.
At the end of December last year, Mr. Moskalev was detained and a criminal case was opened on discrediting the army. The lawyer found it difficult to clarify the grounds for initiating the case, saying that he had not yet “seen the materials”. According to some reports, another post in Odnoklassniki could be the reason. The entrepreneur faces a fine of 300 thousand rubles, arrest for up to six months or imprisonment for up to three years.
