The “Lugovoy Law”, which allows the dispute to be transferred to the court of the Russian Federation if the Russian side is under sanctions, was first applied in a case between Russian and foreign authorities. The Supreme Court of the Russian Federation (SC) recognized the competence of the domestic arbitration court to resolve the dispute between two municipal administrations – the city of Sovetsk in the Kaliningrad region and the city of Pagegiai (Republic of Lithuania), regarding the implementation of the Electronic Democracy project. Moreover, the Russian administration did not even have to prove the imposition of specific sanctions against it, it was enough to refer to Lithuania’s restriction of entry into its territory for citizens of the Russian Federation. Lawyers believe that such an argument will be widely used by Russians in the future and, in general, the position of the Supreme Court “expands the circle of subjects capable of obtaining consideration of their case in the court of the Russian Federation.”
