In the Russian Federation adopted a law on criminal liability for violations in the work of collectors
The State Duma on Tuesday adopted a law that expands the liability for persons engaged in illegal activities to recover overdue debts.
It was introduced to Parliament in June last year. According to the adopted law, collectors will be held criminally liable if their actions involve the use of violence or the threat of its use, the destruction or damage to property, the threat of damage to property, as well as the dissemination of deliberately false information that discredits the honor and dignity of the debtor.
The fine will be from 300 to 500 thousand rubles or in the amount of the salary or other income of the convicted person for a period of one to three years. It also provides for punishment in the form of forced labor for up to 5 years, or imprisonment for up to 5 years.
The law also amends the Code of Criminal Procedure of the Russian Federation – the powers to conduct a preliminary investigation of such crimes are vested in the bodies of inquiry and investigative bodies of the Ministry of Internal Affairs of the Russian Federation.
Now bringing to criminal liability of persons using illegal methods of repayment of overdue debts is possible under the articles “Threat to kill or cause grievous bodily harm”, “Violation of privacy”, “Violation of the inviolability of the home”, “Extortion”, “Arbitrariness”, “Slander” “Intentional destruction or damage to property.” The authors of the bill noted that in practice it is difficult to attract collectors under these articles.
The new law will come into force 10 days after its publication.
