The explanatory note states that the new federal law on citizenship, adopted in April 2023, establishes cases for the termination of acquired citizenship. But these measures apply only to those who have been granted citizenship of the Russian Federation.
“The indicated cases of termination of citizenship do not apply to persons who acquired citizenship by birth or on the basis of recognition as a citizen of the Russian Federation, and apply, among other things, to persons who are recognized as citizens of the Russian Federation on the basis of federal constitutional law,” the document specifies.
Thus, the bill proposes to extend the cases of termination of citizenship, including to persons who acquired citizenship by birth or on the basis of recognition as a citizen of the Russian Federation. The amendments are provided for by the Federal Law of April 28, 2023 No. 138-FE “On Citizenship of the Russian Federation”.
In April, Russian President Vladimir Putin signed a law on the deprivation of acquired citizenship in certain situations. According to the document, it can be forfeited for discrediting the Armed Forces of the Russian Federation (Article 280.3 of the Criminal Code of the Russian Federation), desertion (Article 338 of the Criminal Code of the Russian Federation), calls for the introduction of restrictive measures against Russia and its citizens (Article 284.2 of the Criminal Code of the Russian Federation), rehabilitation of Nazism (Article 354.1 of the Criminal Code of the Russian Federation), violation of the territorial integrity of Russia (Article 280.2 of the Criminal Code of the Russian Federation), etc. The law enters into force 2 October 6, 2023
