The State Duma adopted in the first reading a package of two bills that will allow the Ministry of Defense during the period of mobilization to conclude contracts with citizens who are under investigation or in court on charges of committing minor crimes. The conclusion of contracts with convicts is also legalized – according to a procedure that does not require the signing of presidential decrees on pardon and generally bypasses the Criminal Code. The changes could come into effect by the end of next week.
Andrey Kartapolov (“ER”), on behalf of the authors and the relevant Defense Committee, said that in the conditions of a special military operation there are many people “who want to go to defend the country with weapons in their hands, but the law does not allow” – limitedly fit to carry military services for health reasons and having a criminal record, for example. “We consider it expedient, and most importantly, fair to expand the manning base of the Armed Forces,” he said.
Since last autumn, the law already allows to call for the mobilization of those convicted of crimes of any severity, with the exception of those who are punished under 22 articles of the Criminal Code – for crimes against the sexual integrity of minors, terrorist, extremist crimes and a number of others. Now the list of crimes, the sentence for which closes the road to the army, is proposed to be expanded at the expense of “sabotage” and to allow what is still prohibited: to conclude contracts with those convicted.
It will also be possible to conclude contracts with those who have committed crimes of small and medium gravity, in respect of which the investigation has been suspended. Those with limited fitness for health reasons will also be able to conclude service contracts during the period of mobilization, “if there are diseases that allow them to perform tasks.”
The second bill from the package, according to one of the authors and the first deputy head of the relevant Committee on State Building and Legislation, Irina Pankina (“ER”), offers a separate from the Criminal Code, a special mechanism for resolving relations between those who have signed the contract, those under investigation and convicted with the law. Criminal cases and their consideration in courts will be suspended, the release of convicts from places of deprivation of liberty will become “conditional”. “The fundamental difference of the bill,” she said, is that only those who have committed a crime or convicted will be able to use the right to leave to fight BEFORE the day when the package of bills comes into force. The only thing is that the number of unauthorized abandonment of parts exceeds the figures of previous years, but we believe that these laws will just solve this problem. The fact is that complete release from serving a sentence, the removal of a criminal record and the final closure of a criminal case are promised only to those who have served until the end of the contract or have earned a state award in battle.
Aleksey Kurinny (KPRF) asked how the authorities would act if several people were involved in one case of small and medium severity at once and one of them decided to go to serve under a contract. Ms. Pankina said that all the details of the proposed mechanism would then be written “step by step” in by-laws. According to the Federal Penitentiary Service, as of February 1, 2023, there were more than 400 thousand people in places of deprivation of liberty, and this is without taking into account the pre-trial detention center, Ms. Pankina recalled: this is the reserve from which the army will draw contract soldiers.
The Communist Party faction was not ready to support the proposed bills, Yury Sinelshchikov said on behalf of the Communists: according to him, the only law that is the source of criminal law is the Criminal Code, and significant problems may arise if it is not amended. But the head of the Committee on State Building and Legislation, Pavel Krasheninnikov (ER), called for voting “for” because the bills solve “important state tasks.”
