Human rights activist Chikov: the court declared illegal the entry “prone to lies and deceit” in the military ID

The Volgograd garrison military court satisfied the claim of former serviceman Ruslan Makhno, who refused to participate in the military operation in Ukraine, said human rights activist Pavel Chikov. Mr. Makhno’s military ID wrote that he was dismissed from the ranks of the Russian Armed Forces “due to his refusal to perform special tasks on the territory of the DPR, LPR and Ukraine,” and that he was “inclined to lie and deceive.”
Administrative lawsuit received to the court on 22 August and was considered on 13 October. The decision was made by Judge Vitaly Kirshenman. The case card on the court’s website says that the claim was partially satisfied.
Mr. Chikov published in Telegram an excerpt from a court ruling, from which it follows that the court recognized the entry in the military ID as illegal. By decision of the court, the commander of the military unit is obliged to bring the entries in the military ID in line with the regulatory legal acts. He must fulfill this within a month from the date the court decision enters into force, the ruling says.
Last week, the first criminal case was opened in Russia for refusing to participate in a military operation. Mr. Chikov toldthat the investigation of one of the regions of Russia opened a case under the article “Failure to comply with an order” (part 2.1 of article 332 of the Criminal Code of the Russian Federation) against a contract serviceman. Other details are not yet known. This article provides for two to three years in prison.
