A draft law has been submitted to the State Duma, according to which the guarantors of the dead or disabled of the first group of participants in a special military operation are completely exempted from loan obligations. This was announced by the head of the working group on military operations in Ukraine Andriy Turchak.
According to the current legislation, debts on loans of military personnel are written off if they died while performing tasks during a military operation or from injuries received at that time. However, in the case of a guarantee for loans, in the absence of legislative restrictions, the obligations of the guarantor are assigned to his heirs.
“Such an approach is unfair – the obligations of a member of the SVO, whether he is a borrower under a loan agreement or a guarantor under a surety agreement, practically do not differ. In both cases, he is liable for non-fulfillment of obligations. Our draft law will equalize these situations,” Mr. Turchak wrote in Telegram.
According to Andrei Turchak, such measures will be a logical continuation of the legislative decision to fully write off debts on loans in the event of the death of a participant in a military operation or a severe disability. “If a fighter has repaid his debt to the Motherland to the very end, then the Motherland is obliged to take on his debts. Take care of family and loved ones. Do everything so that they inherit support measures, not loans, ”he concluded.
In October 2022, Russian President Vladimir Putin signed a law on writing off loans to servicemen who died during the military operation and their families. Loans in such cases will have to be closed at the expense of banks. The same law allows conscripts, contract workers and volunteers to receive credit holidays.
