The court session on the case of the kidnapping of a child in the Kanafins family has been completed. The twin boy was stolen from his mother twice. For the first time, when the twins were 3 years old, the father took away a healthy child, and left the boy with cerebral palsy to his mother. The second time he, already 16 years old, was taken away from school. Twice Pasha went through an investigation, a temporary residence center and restoration in a normal comprehensive school. At the end of November, when investigators found Pasha in the Moscow region (and he spent the previous 12 years in Minsk “on the run” with his father), mother Lyuba told MK in a low voice: “He will not be tried for kidnapping. There is such a law – the biological father, even deprived of parental rights in court, cannot be considered a kidnapper.

Anton Kanafin was convicted under article 315 of the Criminal Code of the Russian Federation (“Non-execution of a court verdict”). This refers to the previous decisions of our Themis on depriving him of parental rights and determining for Pasha the place of residence with his mother. Since the defendant fully admitted his guilt, the court considered the case in a special manner. And that usually means a lighter sentence. At the same time, Love Kanafina was not recognized as a victim, she was a witness in the case. Witnesses are not allowed into the courtroom…

– If I were recognized as a victim in such a case, this would be the first case in our judicial practice, a precedent, says Lyuba. – And since only a witness, they did not hear me. People from my support group told me what happened at the trial. We have 250 people in the chat who support me. Anton has a good lawyer. And the prosecutor in his speech did not even mention that there were two children, they stole a healthy one, they left a child with a disability … Only at the end did the prosecutor mention Misha. He crumpled, got confused, read everything from a piece of paper.

– Last time we talked about what they can give Anton from a year to three?

– One of my friends, lawyer Valery, says that under Article 315 it doesn’t matter what it is about. The reasons for non-compliance are of no interest to anyone. Anton stole a child from me or did not demolish the barn for 12 years. And I, not being a victim, cannot appeal against the decision of the court. My lawyer and I wrote two complaints to the prosecutor’s office about an unduly lenient sentence. But these are our laws. It is impossible to condemn a biological parent under article 126 (“Kidnapping of a person” – author).

– Can Anton take Pasha to his place now?

– No, he is deprived of parental rights. But he can sue for reinstatement. Lawyers tell me that if he does this, most likely he will be refused. But I won’t be surprised anymore. And I’m very afraid.

– Pasha has been living with you since December. How are Pasha and Misha doing?

– They’re doing well. But Pasha has a serious problem with digestion. He is not used to breakfast, but he eats up at night, and even spicy food, with different sauces. So my father taught me. From the age of 10, Pasha, for example, drank coffee. He has stomach pains, he constantly takes pills and enzymes. It even comes to hospitalization, we are treated all the time.
