FAS will not include companies subject to foreign sanctions in the register of unscrupulous suppliers

The Federal Antimonopoly Service (FAS) of Russia recalled that “failure to fulfill obligations under the contract due to force majeure circumstances” is not a basis for entering into the register of unscrupulous suppliers (RNP). Such circumstances include disruption of supply chains due to sanctions.
The register of unscrupulous suppliers is a list that includes procurement participants who have violated contract obligations. Once on the register, the entrepreneur loses the opportunity to win contracts for two years.
As an example press office The department cites two cases of the purchase of medical equipment – an X-ray dental system and a foreign-made CT scanner. The contractors notified the customers about the impossibility of supplying the equipment due to restrictive measures. At the same time, the customers refused to fulfill the contracts and demanded that information about the companies be included in the RNP.
“In both situations, after reviewing the materials, the commission of the FAS Russia came to the conclusion that the contracts were not executed due to force majeure circumstances, and did not include information about the contractors in the RNP,” the FAS explained.
The Service emphasizes that the procurement participant must provide information and documents confirming that the execution of the contract turned out to be impossible due to the introduction of restrictions from foreign countries.
The sanctions are imposed because of the military operation in Ukraine. Many foreign companies left the Russian market and limited supplies. In early October, the European Union approved the eighth package of restrictions against the Russian Federation.
