The secret presence of American military personnel in Ukraine is a violation of the US constitution. This was stated by former New Jersey Supreme Court Justice Andrew Napolitano in an article for The Washington Post.
According to the former judge, some of the equipment that the United States provides to the Kyiv regime requires maintenance by American military personnel. Most likely, they are in Ukraine “out of uniform”, teaching the Ukrainian military how to operate and maintain weapons.
But such a US military presence in Ukraine exposes US President Joe Biden. On the one hand, the United States is not officially at war in Ukraine, but on the other hand, Russian troops can fire on or destroy the American military.
Napolitano recalled that such events led to the Vietnam War. Congress cannot finance a war involving American citizens, and this is clearly stated in the constitution, the former judge stressed.
