The reason for the two-hour stoppage of traffic at one of the sections of the BCL opened on March 1 was drilling work, which was carried out by the Donstroy contractor at the site where the Sobytye residential complex is being built. As a result of these works, a hole was punched in the wall of the metro tunnel, through which a mass of clay, sand and water was thrown out on the way. Lawyers believe that both the contractor and the developer can bear property liability in this case. The head of the Moscow Department of Transport, Vice Mayor Maxim Liksutov, called the incident “irresponsible and negligent.” It should be noted that the accident at the BKL is not the first incident in the metropolitan metro associated with unintentional drilling of tunnels by builders.

On Monday afternoon, for about two hours, there was no train traffic on the section of the Big Circle Line of the Moscow metro between the Novatorskaya and Aminyevskoye highway stations. Clockwise trains did not run during this period, oncoming trains followed at increased intervals for some time. Large concentrations of passengers formed at the stations, to help them, the deptrans announced the launch of special ground transport routes, which could be used free of charge. Fully traffic with passengers was restored at 12:25 after a complete check of the infrastructure of the affected landfill.

According to the Moscow Mayor’s Office, the reason for the traffic stop was an accident in the tunnel between the Michurinsky Prospekt and Aminyevskoye Shosse stations: as the deputy mayor of the city and head of the Moscow Department of Transport Maxim Liksutov explained, as a result of construction work on the surface, the drilling machine drilled a hole, which led to to the release of clay, sand and water on the way. The movement of trains in a clockwise direction was stopped for the period of restoration work, the movement of oncoming trains did not stop.

Mr. Liksutov said that the accident arose as a result of a violation of safety rules at a commercial construction site, which is carried out by the Donstroy company “without the necessary approvals.”

“Such irresponsibility and negligence should not be repeated,” Mr. Liksutov said. The Moscow metro, according to him, immediately turned to the Investigative Committee and the Main Directorate of the Ministry of Internal Affairs for Moscow with a demand to carry out the necessary verification and initiate a criminal case. Later, a senior assistant to the head of the Moscow Department of the TFR, Yulia Ivanova, told reporters that construction and project documentation, contracts and other documents on financial and economic activities were being confiscated from the construction company that carried out the work.

Mosgosstroynadzor stopped work at the construction site until all the circumstances were clarified, for which a technical commission was created. Mosgosstroynadzor told RIA Nedvizhimost that the incident would be checked from March 16 to March 29, 2023; based on its results, the general contractor may be fined or a decision made on the administrative suspension of activities for up to 90 days.

Donstroy is building the Sobytiya residential complex over the affected area. m, follows from the construction documentation. In January 2023, Donstroy reported that it had completed monolithic work in all five sections of the second quarter. As stated on the portal “Nash.Dom.RF”, the commissioning of the residential complex “Event” is planned for the first quarter of 2025.

In Donstroy, they told Kommersant that they were the customer for the construction at the address between the street. According to a representative of Donstroy, the developer takes an active part in the work of the commission set up to investigate the incident together with the executive authorities, as well as structural units responsible for the construction and operation of metro facilities. “Maximum efforts are being made to eliminate and minimize the consequences of the accident,” Donstroy says. At the Antteq office, “Kommersant” did not promptly respond.

Forward Legal lawyer Oleg Sheikin says that there is a risk of property liability to the city and third parties for both the general contractor and the developer.

According to him, the general contractor is liable as a person whose actions directly led to the harm. And the developer may be liable for damage due to his increased liability in accordance with the Town Planning Code of the Russian Federation, the lawyer points out. As Mr. Sheikin noted, if the developer has to compensate for the damage, he may demand compensation from the general contractor under the terms of the contract.

The Big Circle Line was fully put into operation on March 1 this year after the commissioning of its last section between Maryina Roshcha and Varshavskaya stations. The Moscow authorities consider the BCL to be one of the most important elements of the capital’s transport framework; According to Moscow Mayor Sergei Sobyanin, in the first five days of the line’s operation, Muscovites and guests of the city used it 4 million times.

Accidents in the subway related to violation of safety rules during drilling and piling have already taken place: for example, on the afternoon of January 22, 2014, a construction pile was driven into the tunnel of the Zamoskvoretskaya metro line between the Avtozavodskaya and Kolomenskaya stations, which led to a stop movement and temporary blocking of trains with passengers in tunnels. On March 19, 2006, a pile structure for an advertising billboard on the surface broke through the tunnel of the Zamoskvoretskaya line between the Sokol and Voykovskaya stations. In this case, it was not possible to prevent damage to the train moving towards the center: the driver noticed the pile and started braking, but the object crushed the cab and eventually got stuck in the third car. The workers on the surface did not immediately notice that the piles were sinking into the tunnel. The company that installed the advertising structure was working without the necessary permits; its director was detained the next day as part of a criminal case. In all cases, human casualties among passengers were avoided.
