EU interim measures continue to apply to racer Mazepin

The interim measures of the European Union (EU) against the Russian Formula 1 racer Nikita Mazepin continue to be in force, his representative told Kommersant. Previously, in the Official Journal of the EU it was published order of the Court of Justice of the European Union to annul the measures. However, as explained by Mazepin’s representative, decisions of the Court of General Jurisdiction on the adoption of interim measures are not published urgently, unlike appeal decisions of the Court of Justice. Thus, it is impossible to track whether measures were lifted and then reinstated.
According to the representative, on September 20, 2023, Nikita Mazepin filed an addition to his claim to the EU Council, in which he appealed the new sanctions of September 14. Also on October 2, Mazepin filed a new application for interim measures based on the amended claim. The European Court of Justice granted this application on a preliminary urgent basis the next day. “Thus, interim measures in favor of Nikita Mazepin are again in effect, and the grounds on which the previous decision was appealed have been eliminated,” he clarified.
According to the driver’s representative, the misinterpretation of the court’s decision arose due to the fact that, unlike appeal decisions of the Court of Justice (CJEU), decisions of the General Court on urgent interim measures are not published. “Therefore, the observer sees that the measures were canceled, but that they were later restored is not obvious,” he added.
Nikita Mazepin competed in Formula 1 for the American Haas team. In March 2022, he came under EU sanctions along with his father, Dmitry Mazepin, owner of the Uralkali company, which was one of the title sponsors of Haas. Haas also refused to cooperate with Nikita Mazepin. July 31 Mazepin achieved partial suspension of restrictive measures through the EU Court. He retained the right to enter the EU for negotiations with Formula 1 teams and sponsors. He was also allowed to earn income from racing activities.
