Draft on prohibition of seizure of property without a conviction submitted to the State Duma

A draft law has been submitted to the State Duma to regulate the process of turning citizens’ property into state revenue, TASS reports. According to the amendments, it will be possible to recover property only if the illegality of obtaining income for which it was acquired is established by a conviction that has entered into legal force.
In particular, the deputies propose to clarify in Art. 235 of the Civil Code of the Russian Federation, that the property of a citizen whose guilt in committing a corruption offense has been proven by a court can be turned into state revenues.
The initiators of the document were deputies from the New People party Vladislav Davankov and Alexander Demin. The project was also supported by the deputies of United Russia, the Liberal Democratic Party and the Communist Party of the Russian Federation.
According to the current Russian legislation, property from the owner or another person can be turned into state revenue, regardless of whether his guilt in committing a corruption crime has been proven.
