Deputies corrected amendments on foreign agents

State Duma deputies have prepared amendments to the second reading of a package of bills on amendments to the Criminal Code (CC) and the Code of Administrative Offenses (CAO) on liability for foreign agents. The documents adopted in the first reading on October 19 were prepared by members of the commissions of the Duma and the Federation Council for combating foreign interference in connection with the law “On Control over the Activities of Persons Under Foreign Influence” adopted in the summer, which comes into force on December 1 and summarizes provisions of various laws governing the status of a foreign agent.
Most of the amendments to the second reading are of a technical nature. In particular, legislators have removed the old wording “acting as a foreign agent” everywhere, replacing it with simply “foreign agent”. Another amendment to the Code of Administrative Offenses was a response to the claims that arose from the State Duma’s relevant committee on legislation. In his opinion, he pointed out the lack of clarity and unambiguous understanding in which cases a person can be classified as “intending to act” as a foreign agent. Therefore, for the second reading, Irina Pankina (United Russia) introduced an amendment excluding the words about such “intentions”.
At the same time, some of the amendments introduced for the second reading go beyond the scope of the original “foreign agency” theme. For example, United Russia Anatoly Vyborny proposed to strengthen the criminal penalties for non-profit organizations that “encroach on the personality and rights of citizens” (Article 239 of the Criminal Code). Now for the creation of an association, whose activities are “involved with violence against citizens or other harm to their health”, as well as for the leadership of such an NGO, you can get up to four years in prison, but now the term will increase to seven years. And the maximum punishment for the creation or leadership of an NPO, whose activities are “involved in inciting citizens to refuse to perform civic duties or to commit other illegal acts,” will increase from three to six years in prison. Finally, participation in the activities of such an NPO will be punishable by a fine of up to 200,000 rubles. (now – 120 thousand) to imprisonment for four years (instead of the current two years).
