Complaint-comic: Russian convict filed an appeal in pictures for the first time

The court could not refuse
Perhaps the first appeal in the history of modern criminal law “in pictures” was recently received by the Rostov Regional Court. The Russian, who disagreed with the harsh sentence, considered that it would be more convincing to draw his version of what happened than to describe everything in words.
Citizen Peresadko, who was found guilty of the murder of classmate Roman, acted as the “artist”. According to the court and the investigation, while drinking alcohol between the men there was a conflict, Peresadko grabbed a knife and inflicted mortal blows on his friend. The Shakhty City Court of the Rostov Region sentenced him to 9 years and 11 months in a strict regime colony. The man did not agree with such a harsh verdict. He assures that the deceased provoked the conflict – he insulted him, called him henpecked and generally interfered in his relationship with his wife. And when a fight broke out, it was he who allegedly grabbed the knife first, and Peresadko simply defended himself. In general, he insists that it was self-defense, not murder.
In his appeal, he drew a picture of himself and a classmate sitting in the kitchen. He depicted all the decoration of the room where the tragic events unfolded: a refrigerator, stools, a light bulb, etc. He drew moments of pouring alcohol, and also placed phrases in the “cloud” (Roma’s speech: “Heel! Henpecked!”) And explanations (“Apparently, Roma was very offended by my wife after she sent him three letters”). The complaint itself has become like a comic book. But Themis could not refuse to accept it.
“Any appeal is acceptable if it contains certain attributes,” says lawyer Vadim Bagaturia. – Article 389.6 of the Code of Criminal Procedure of the Russian Federation sets the criteria: the name of the court to which it is submitted, information about its submitter, an indication of the contested judicial act, the arguments of the complainant, a list of attachments and a signature. Of course, in the appeal you can not use swear words or insults. But the law does not say anything about the form of the complaint – written or graphic. When studying the “masterpiece” of the defendant Peresadko, it becomes clear that he fulfilled all the requirements of Article 389.6 of the Code of Criminal Procedure of the Russian Federation, which means that the court of appeal could not refuse to consider his complaint. From the point of view of clarity, this form of complaint is head and shoulders above the text, which guarantees its careful study by the judges, that is, the result may be in favor of Peresadko more likely than in other cases.
If this turns out to be the way the lawyer suggests, then a precedent will be set. As a result, other inmates will probably want to file complaints “in pictures”. By the way, the judges themselves (those whom I managed to interview) consider this to be quite normal. And “handling illustrations” is much more interesting to read than just text.
