The electoral commissions cannot prevent candidates for elections at all levels in Russia from providing detailed information about their biography, the Constitutional Court (CC) of the Russian Federation specified. Separate provisions of the electoral legislation, representatives of the court explained, cannot be interpreted as grounds for refusing candidates to edit information about their professional experience.
“The constitutional and legal meaning of clause 1(1) of Article 38, subparagraph “d” of clause 5 and clause 17 of Article 63 of the Federal Law “On Basic Guarantees of Electoral Rights and the Right to Participate in a Referendum of Citizens of the Russian Federation”, as well as clause 4 part 5 of article 35 of the electoral code of the city of Moscow is generally binding, which excludes any other interpretation of them in law enforcement practice, ”the document posted on website court.
The reason for checking the articles of the federal law was the complaint of Galina Viryasova, a resident of Moscow, who in September 2021 was nominated to the council of deputies of the Shchukino municipal district. When registering her candidacy, Ms. Viryasova indicated her employment status as “product manager”, but later, due to a change in position, she decided to change it in the ballot to the position of “head of the test development group”. The election committee refused to amend the biography of the candidate.
