Apple allowed the refusal of the function of measuring blood oxygen from smart watches

Apple may exclude the function of measuring blood oxygen levels from its latest Apple Watch Series 9 and Ultra 2 models, the agency reported. On December 21, the US International Trade Commission (ITC) confirmed a ban on the sale of certain Apple Watch models due to infringement of a Masimo patent.

The day before, the US Customs and Border Protection (CBP) decided that the ban on the import and sale of Apple Watch Series 9 and Watch Ultra 2 smartwatches in the US could be lifted when the devices are upgraded, reported Reuters. Exactly what changes we are talking about were not specified.

As noted by Reuters and Bloomberg, Apple is working on upgrading the software to eliminate the use of pulse oximetry technology, which is the technology Masimo patented. The company’s modernization plans influenced CBP’s decision, Bloomberg notes.

The ban on the sale of Watch Series 9 and Ultra 2 models came into force on December 26. Court decidedthat Apple violated Masimo’s patent by using a blood oxygen level sensor in its watch. On December 26, Apple filed an appeal against the import and sales ban and asked the court to delay the start of the ban while it considers its appeal. December 27 sales resumed while the company’s complaint is being considered.
