Amendments on electronic subpoenas to the military enlistment office imply a temporary travel ban

The travel ban for citizens of the Russian Federation who were called up for military service will be in effect from the day the summons is served, follows from the text of the amendments to billaimed at improving the system of alerting citizens about their appearance in military registration and enlistment offices. The restriction will be in effect until the appearance at the military commissariat.

“Citizens who are subject to conscription for military service and who have received a summons from the military commissariat, from the day when, in accordance with federal law, such a summons is considered handed in, are prohibited from leaving the Russian Federation,” the document states (.doc).

In addition, failure to appear without a valid reason within 20 days from the date indicated in the agenda will entail:

• a ban on state registration as an individual entrepreneur;
• a ban on registration with the tax authority of an individual as a taxpayer applying the special tax regime “tax on professional income”;
• suspension of rights to register real estate for state cadastral registration and (or) state registration of rights;
• restrictions on the use by a citizen of the right to drive vehicles;
• ban on state registration of vehicles;
• refusals to conclude a loan agreement, a loan agreement.

According to the amendments, the authorities of the constituent entities of the Russian Federation will have the right to establish additional restrictions related to the receipt of payments, benefits and regional support measures.

The bill additionally provides for the possibility of serving subpoenas not only in person (against the signature of the draftee), but also by registered mail, as well as electronically through the State Services. It is indicated that in the latter case, the summons will be considered delivered “from the moment it is posted in the citizen’s personal account on the relevant information resource.”

In the event that the subpoena, which was sent by letter or electronically, formally continues to be considered not served, it will be considered as such after seven days from the date of its placement in a special “registry of subpoenas”.

The State Duma will consider a package of amendments regarding the system of conscription for military service in the second reading today, April 11. Formerly head of the profile committee of the State Duma Andrey Kartapolov emphasizedthat the new rules for obtaining subpoenas will affect not only conscripts, but also all those liable for military service. According to him, the summons will be considered delivered from the moment it appears in the personal account on Gosulugs.
