Defendant faces up to two years

The Kanash inter-district prosecutor’s office in Chuvashia approved a criminal indictment against a 32-year-old resident of Kanash who secretly filmed her sister naked and forwarded the video to her ex-husband. The sister could not stand the insult, turned to law enforcement agencies, and the insidious relative will now be tried under the article “Violation of privacy.”

The investigation found that the video was filmed at the moment when the lady was in the garden. Seeing her naked sister in front of the entrance to the bathhouse, the resident decided to take a picture of her. And then she sent a “naked video” to her ex-husband. And later I was surprised to learn that these were not jokes at all, but a crime: “Illegal collection and dissemination of information about private life.”

After the confirmation of the indictment, the criminal case was transferred to the Kanash District Court.

Local residents put forward their versions of the woman’s act. “I heard that the ex-husband of this woman became close to this sister of hers, and the girl was in the bathhouse of another man,” says one of the neighbors. – So that relative decided to send a video of her sister, who is in front of the bathhouse of that man, as evidence.

Another neighbor suggested that the ex-husband decided to hit on his wife’s sister after the divorce, and she, in retaliation for the more successful rival, decided to show the man all the “flaws and imperfections” of her sister’s figure, or some features of her body, which he, apparently, has not yet suspected.

“The collection of information about private life is understood as deliberate actions consisting in obtaining this information in any way,” said Dmitry Kurepin. – For example, through personal observation, including fixation by video means, as in this case. Distribution consists in disclosing this information to one or more persons orally, in writing or in any other form and in any way, including via the Internet.

In our case, as far as I understand, the defendant’s sister did not give her consent to video filming, which means that this information (video recording) was obtained illegally. Her relative not only made the recording, but also distributed it by sending it to her ex-husband.

What punishment does she face?

– The sanction for committing a crime under part 1 of article 137 of the Criminal Code of the Russian Federation (illegal collection or dissemination of information about the private life of a person) is alternative, that is, it can be either a fine, or compulsory work, correctional labor, or maybe arrest and deprivation freedom. The maximum penalty is up to two years in prison.

This crime is not a matter of private prosecution, so the victim did not file an application to the court herself. The prosecutor’s office came out with an accusation, and before that a preliminary investigation was carried out.
