A patient sued the Balashikha Regional Hospital for over 250,000 rubles for poor quality medical services. The woman accused the doctors of mistakenly performing abdominal surgery on her, after which she had a long recovery.
As MK found out, two years ago, a resident of the Moscow region, Maria (name changed), was admitted to a regional hospital with complaints of abdominal pain. The patient was examined by a gynecologist and pronounced that there were no problems in his area. Then the doctors suspected appendicitis and put the woman on the operating table. Maria underwent abdominal surgery under general anesthesia – laparotomy. But the diagnosis of appendicitis was not confirmed.
After this, the patient was transferred to the gynecology department, where a new diagnosis was made: polycystic ovary syndrome with complications. She was prescribed treatment and a week later she was discharged home with improvement.
However, Maria was dissatisfied with the quality of the medical care provided. She filed a lawsuit in the Zheleznodorozhny City Court, in which she accused the doctors of not conducting a thorough enough diagnosis upon admission, which led to an unnecessary operation, and the intervention affected her health. The stitch took a long time to heal painfully; she could not care for her one-year-old child, since she herself needed care. Maria demanded compensation from the hospital for moral damage – 400,000 rubles – and reimbursement of expenses.
The court ordered a medical examination. Experts identified a number of violations in providing care to the patient. Thus, the doctors did not perform an ultrasound on her, the gynecologist’s examination was incomplete, her blood glucose level was not monitored, etc. Nevertheless, the experts came to the conclusion that the operation was not carried out in error. Doctors could have performed a laparoscopy (where surgery is done through a small hole rather than large incisions), but they lacked the sterile tools to do so. Therefore, a laparotomy was performed. The experts decided that, despite the doctors’ mistakes, no harm was caused to the patient’s health.
However, the court still sided with Maria. The judge was outraged that the regional hospital did not have sterile instruments. According to the journal entries, no operations were performed in the hospital that day, which means that doctors had the opportunity to intervene in the patient’s body in a more gentle way, using a laparoscope. The method of surgery chosen by doctors led to unpleasant consequences that could have been avoided.
The claim was partially satisfied: the hospital was ordered to pay the patient compensation for moral damage in the amount of 200,000 rubles. She must also be reimbursed for legal expenses – 50,000 rubles, notary expenses – 2,000 rubles.
