He also received money from the store for moral damages.

A client who was refused to sell non-alcoholic beer without a passport was sued for five thousand rubles from a well-known alcohol market. The cashier decided: since the drink contains a small amount of ethyl alcohol, it is prohibited for sale to minors.

As MK found out, some time ago a scandal broke out in a popular liquor store on Kostyakova Street. A young man named Mikhail decided to drink non-alcoholic beer. His choice fell on a beer drink with grapefruit and pineapple flavors costing 46 rubles. The guy handed the jar to the cashiers, but the employees were in no hurry to clear the purchase. Instead, they demanded from the client a passport confirming his majority. Mikhail did not have the document. Then the employees refused to sell the beer, citing the fact that it was alcoholic.

The conversation turned into a conflict: the buyer tried to prove that the drink was not alcoholic, as evidenced by the label. However, the sellers remained adamant and did not sell the young man beer. Mikhail filmed the showdown on his phone camera and went with this evidence to the Timiryazevsky District Magistrate’s Court.

The judge examined the video provided by the plaintiff and ruled that the buyer was right and the store violated the Consumer Protection Act. A beer drink with an ethyl alcohol content of no more than 0.5% is indeed not considered alcoholic. This means that it is not subject to the ban on sales to minors. Sellers were required to sell fruit beer to the client without requiring a passport.

However, the judge decided to partially satisfy the claim and reduce the requested amounts. Mikhail asked to compensate him for moral damages in the amount of 7,000 rubles and to fine the store for more than 5,000 rubles. But Themis assessed the moral damage caused at 500 rubles. And she imposed a fine of 250 rubles. In addition, the store was ordered to reimburse the buyer for legal costs – 4,000 rubles – and postage costs – just over 300 rubles. In total, the alcohol market must pay the client 5,088 rubles.
