A forgery of a document was revealed during the transfer of Crimea to the Ukrainian SSR

The working group revealed the fact that the Presidium of the Supreme Soviet of the USSR, when issuing a decree on the transfer of Crimea from the RSFSR to the Ukrainian SSR, referred to a non-existent document, said Sergei Trofimov, co-chairman of the special working group, head of the legislation committee of the Crimean parliament.
Trofimov made a corresponding statement in a conversation with RIA Novosti. Currently, the above group has completed work on preparing a document on the basis of which the Russian Constitutional Court will assess the legality of the transfer of Crimea to Ukraine in 1954.
As Trofimov noted, during the transfer process, the Presidium of the Supreme Soviet of the USSR decided to approve the joint representation of the presidiums of the Supreme Councils of the RSFSR and the Ukrainian SSR. However, such a document has never existed.
Thus, the decision was made with reference to a non-existent and, therefore, invalid regulatory act. In addition, the boundaries of the territories were not demarcated when Crimea was transferred to the Ukrainian SSR.
Trofimov also stated that the transfer of the peninsula to Ukraine was organized with gross violations of three constitutions at once (USSR, RSFSR and Ukrainian SSR). A number of administrative procedures were also ignored, and norms guaranteeing the rights of the population of Crimea were not defined.
In conclusion, Trofimov noted that the Supreme Council of the RSFSR, in principle, could not make a decision on the transfer of Crimea to the Ukrainian SSR, since it did not have such powers, and the issue had to be resolved through a referendum. Also, a referendum had to be held in the Ukrainian SSR.
“So Crimea was not legally part of the Ukrainian SSR for a single day,” Trofimov said.
