A family with five children was forcibly relocated without better living conditions

Until Monday, the Suvorovs, a large family of Muscovites, lived on the basis of a social tenancy agreement in a two-room apartment with a total area of ​​41 square meters in Fili-Davydkovo. The apartment was still left to them by the grandmother of the spouse, who died three years ago. “We used to live with my mother-in-law, now the husband is the responsible tenant. It has been on the list of people in need of better living conditions since 2001. That is more than twenty years.”

It turns out that the father of the family himself stood in line as a schoolboy. And all his life he stood in it … The line almost did not move.

Since they recently received an answer that the number of families registered for improvement to Alexander Suvorov is currently 17092.

Now the eldest son is 16, daughters -14. The next common children are 6 years old, 2 years old and the youngest was born as recently as March 2022.

Both spouses work at defense enterprises, that is, their work is important and necessary – especially at the present time.

When they found out that the house was included in the housing renovation program, they were very happy, it was a real chance to move.

When the youngest daughter was born, the couple immediately prepared all the documents and a statement so that she, too, could be put on improvement. But they were refused on the grounds that the re-registration of the accounting file was carried out in January of this year, the girl was born a little later, so the next re-registration with her participation is possible no earlier than a year later. Okay, temporarily minus one girl, okay. But six people remain.

“In May, we were finally given a viewing room for a three-room apartment. There were 72 squares. Before that, all options were offered in the region of 60 meters. Therefore, we immediately signed an agreement and have already begun to collect furniture and things.”

But, according to Muscovites with many children, this proposal was suddenly canceled. They still do not know the exact reason for this decision. “They didn’t explain anything to us, how, why, we didn’t understand anything. They asked to explain this point, why we were denied a three-room apartment. And we were suddenly informed that our children, it turns out, are not at all worth improving their living conditions as needy, that my husband is still on this account alone. Although we submitted information about the children several times, and all the documents are on hand. But since there are no children on the lists, then we are entitled to only an equivalent two-room apartment, as it was before, only, instead of 41 meters – 59 meters, this will be considered an improvement. Therefore, he is removed from the preferential queue. ”

Yes, in all the explanations that were sent by the Suvorovs, it was indicated that for some reason only one father, and not members of his family, was in the queue for housing “out of turn”. But is it really the fault of the parents that several underage Muscovites were “lost” somewhere on paper?

At the end of August 2022, the “missing” younger children were not only found, but they believed that they exist and also need to improve their living conditions. The Suvorovs were promised that as soon as they were registered, the issue would be resolved. No, now they will not be given a larger apartment anyway, but they will provide an additional subsidy. “It was previously reported that it “may be” up to 4.5 million rubles, but then we ourselves recalculated using a special calculator and it turned out that, most likely, it would be no more than 1 million 700 thousand rubles. As we already understood, you can promise anything, but how can we improve by this amount at current prices? This is not even enough for us to change a kopeck piece for a three piece.”

There is a standard established by paragraph 6 of Article 20 of the Moscow Law of June 14, 2006 “On Ensuring the Right of Moscow Residents to Housing (“for a family of six or more citizens – a residential building with an area of ​​18 square meters per family member.”) The Suvorovs believe that that in their situation this standard is not met. 8 meters is clearly not 18. Meanwhile, officials insist that the two-room apartment where they are forcibly relocated is the best that a family can generally count on.

Extra house in the village

It turns out that when calculating social norms, 44 square meters in a village in the Saratov region, which belong to Nadezhda Suvorova, were also taken into account. She herself comes from there and at one time in 2010, when there were two more children, she bought 1/2 of the house on a mortgage for maternity capital. Just to have something. Yes, the hut is old, located 150 kilometers from Saratov, almost 1000 kilometers from Moscow, so with all the desire of parents with children living in the capital, it is neither hot nor cold from it.

“But it was included in the total footage and it was considered that with regard to our family, all social norms for providing housing, taking into account my property in the Saratov village, were taken into account,” Nadezhda sighs. She says that they would be glad to get rid of this house, to sell it, even at a cheap price. They can’t. Since this will be considered a deterioration in living conditions for minor children. And now, it turns out, their conditions have not deteriorated?

On September 12, 2022, the Dorogomilovsky court heard a lawsuit for the forced eviction of this large family. The Suvorovs lost the court. “The reasoning part of the decision has not yet been given to us, we have already complained about it. Only the bailiffs had a writ of execution when they evicted us.”

By that time, all the neighbors had already left their resettled five-story building. The house is being demolished. The Suvorovs were the last. Delay the start of work. Light and water were still there. But the heating was not even turned on.

Being in such a cold with a baby is absolutely impossible. Therefore, a month ago, when it became cold outside, all the children were transferred to their grandmother’s one-room apartment, while they were packing their things.

Until late in the evening, on their last fifth floor, the only window was burning … And in the morning the bailiffs came, and it was impossible to do anything.

“Yes, until the last moment we refused to voluntarily move seven of us to that tiny two-room flat of 59 square meters, because we understood that if we move there, that’s all, we will never get out of there,” the Suvorovs explain their stubbornness.

It was useless to resist and object. In fact, they were given a new apartment. Probably, they can, if they want, once again apply for the improvement of living conditions – Alexander and his children may receive it in addition to his pension. But it is not exactly. The queue is big.

A faster option is to again try to defend your rights in court, on December 15, 2022, their response claim will be heard about the violated right to provide housing out of turn for at least three rooms under the renovation program.

“Your housing issue will be considered in accordance with the norms of the current legislation in order of priority,” they answered in a regular letter dated October 5, 2022. They hope that there their arguments and request will be heard.

Seven on the benches

“You yourself think – how can we continue to live seven of us at 59 meters?” – the Suvorovs are perplexed. If we proceed from social standards, then indeed, they should have given an apartment of at least 100 square meters.

“How is it – everywhere they say that it is necessary to help large families, that they are the stronghold and the future of Russia, but for some reason it turns out that no one cares about us,” Nadezhda Suvorova also shrugged her shoulders. She has a lot to worry about now. We need to unpack things in a new place. Although, deep down, Nadezhda still hopes that their issue will be resolved not only according to the law, but also in justice.

To whom only they did not complain: from the capital’s mayor’s office – to the Commissioner for Children’s Rights. And everywhere their complaints are simply forwarded to the authorities or they write high-level replies in response, in the department of social protection of the district, for example, the Suvorovs were informed that “in accordance with the Family Code, parents are responsible for the upbringing and development of their children. They are obliged to take care of their health, their physical, mental, spiritual and moral development.”

And if there are any other questions, they recommended to go to court. But at the same time, they did not tell how best to take care of physical and mental health at eight meters per person, including adult members of the family.

“The paradox is that the situation with this large family from the outside seems completely unfair, absolutely legal from a legal point of view,” says lawyer Alexander Skovorodko. – At least, as I see from the information that was provided.

It must be understood that when it comes to real estate, especially that provided by the state free of charge, it is necessary to check everything in advance to the last document. The fact that part of the house was purchased from my mother for maternity capital in a mortgage, and these meters were taken into account when providing new housing, is a very serious circumstance. Yes, the house is located in a Saratov village, and none of the family members live there. But that doesn’t mean anything.

In my practice, there was a case when the family of a military honored officer was supposed to receive an apartment in Moscow, but just a week before the warrant was handed over, a kind grandmother gave her granddaughter an apartment in Ryazan. Everything, instead of the prescribed three rubles, they gave one, because they deducted the footage of the Ryazan apartment.

Another specific example – the family had to get housing not just in Moscow, but in the Balchug area – in the very heart of Zamoskvorechye. There was a judgment in hand. It turned out that the father-in-law in Voronezh privatized a part of his apartment for his daughter and granddaughter a long time ago and did not say anything to anyone. The truth came out too late. We also figured out if there is fraud on the part of the recipients of housing. Understand that no one is interested in the difference in the value of real estate – that in Moscow it costs tens of millions, and in the provinces – two or three, when calculating social standards, only square meters are taken into account. Was it necessary according to the standards of 100 + squares? 59 + 44 = 103. Therefore, you should always think carefully before making a decision on privatization or the use of maternity capital.

As for the “unrecorded” children, who were also supposed to stand in line for improving their living conditions, but disappeared somewhere, then we need to look more closely at why this happened, and who exactly could be to blame for this. And go to court if people think their rights have been violated. Although, from the point of view of the fact that a large family of Muscovites suffered, of course, this issue, I think, should be resolved on an individual basis.
