A draft law on the specifics of criminal liability for participants in the military operation in Ukraine has been submitted to the State Duma. In particular, according to the document, citizens called up for mobilization and those who have concluded a contract for military service in the NVO zone can, in some cases, be exempted from criminal liability for minor crimes.
The document is placed in the database of bills on site GD. The authors of the draft law were Senator Andrei Klishas, head of the State Duma Committee on State Construction and Legislation Pavel Krasheninnikov, and the first deputy head of this committee, Irina Pankina. All of them represent the United Russia party.
The authors of the document propose to add to the legislation a rule that mobilized and contract soldiers who have committed crimes of small and medium gravity are exempt from criminal liability from the day they are dismissed from service or receive a state award.
“The legal mechanism for exemption from liability will contribute to the achievement of the goals of punishment, as well as provide additional opportunities for manning the Armed Forces of the Russian Federation,” the explanatory note to the bill says.
June 10 State Duma Defense Committee recommended to the adoption in the first reading of a draft law allowing citizens with a criminal record (except for “serious” articles) to serve under a contract in the Armed Forces of the Russian Federation during the period of mobilization and in wartime. He will also allow contracts to be limitedly fit for service (if they do not have diseases specified by the list of the Ministry of Defense).
