A draft law on fines for violations in the use of biometrics was submitted to the Duma

State Duma Chairman Vyacheslav Volodin and leaders of all Duma factions submitted to the lower house of parliament a bill introducing fines for violations in the use of biometric data of Russians, reported press service of the State Duma.
In an explanatory note to document it is noted that now there is administrative responsibility for the processing of personal data without the consent of the person or with violations of the requirements for the composition of such information, to the processing of which the user agreed.
The bill introduces administrative liability for placing biometric personal data in violation of the requirements established by law in the unified biometric system (UBS) and other systems that provide identification using biometrics.
The fine for individuals for such violations will be 6,000 – 10,000 rubles, for officials – 100,000 – 300,000 rubles, and for legal entities – 300,000 – 700,000 rubles. In case of repeated violation, the amount of the fine increases for officials to 500,000 rubles, for individual entrepreneurs – up to 1 million rubles, and for legal entities – up to 1.5 million rubles.
It is proposed to increase the existing fines for illegal processing of personal data to the same values.
The bill, the explanatory note says, is aimed at protecting the biometric data of citizens, as well as preventing administrative offenses.
December 29 Russian President Vladimir Putin signed a law prohibiting the forced collection of biometric data of Russians, as well as any discrimination against those who refused to surrender it. Refusal to submit biometrics can be issued in writing through any branch of the MFC. Citizens who do not want to provide biometric data will not be able to be denied services, including state and municipal services, any discrimination or denial of services in connection with this will be punished.
The EBS was established in 2018 at the initiative of the Ministry of Communications and Mass Media (successor – Ministry of Digital Development) and the Bank of Russia. Its operator was appointed “Rostelecom“. Now you can take biometrics – a cast of your face and voice – only in person at a bank branch or MFC. Scenarios for using the system were originally tailored for the banking sector and provided for the possibility of opening a bank account or obtaining a loan.
