A draft law on alternative civilian service during the period of mobilization was submitted to the State Duma

A draft law has been submitted to the State Duma that allows for alternative civilian service (ACS) during partial or general mobilization. The relevant bill there is in the base of bills of the State Duma. The bill was prepared by deputies Sardana Aksent’eva and Maxim Gulin.
As follows from the document, the authors propose to consolidate the right to ACS not only for representatives of indigenous peoples and those whose beliefs are contrary to military service, but also for those:
- who has three or more dependent children under the age of 18,
- who has one or more dependent children under the age of 18, who are brought up without a mother,
- who has a wife who is at least 22 weeks pregnant and has two dependent children under 18,
- who have disabled children, if the conscript is the only breadwinner in the family,
- who is the only child of a single parent,
- who is the son or brother of military personnel who died in the course of their military service duties.
The draft law also proposes to exclude paragraph 2 of Article 4 from the Federal Law “On Alternative Service”, which establishes the extraterritorial principle of passing the ACS. Citizens must now perform this service outside the regions of Russia where they permanently reside. In practice, as lawyers note, this rule rarely works.
“Citizens in the reserve have the right to replace military service on conscription with alternative civilian service during the period of partial mobilization and can be sent to work provided for in Article 4 of the Federal Law “On Alternative Civil Service”, including to ensure the safety of educational organizations”, — stated in the explanatory note to the bill.
Partial mobilization in Russia has been taking place since September 21.
