A court in Russia equated emoji to a signature in a document – Kommersant

Fifteenth Arbitration Court of Appeal of Rostov-on-Don confirmed the decision of the Arbitration Court of the Krasnodar Territory, which accepted the “thumbs up” emoji for agreeing on the terms of the purchase and sale agreement for a retail kiosk. According to the court’s decision, the emoji may have legal force because it is “commonly understood to mean ‘good’.”
According to the court ruling dated June 29, businesswoman Siranush Harutyunyan entered into a purchase and sale agreement with Rodion Rudenko in March 2022. Mrs. Harutyunyan wanted to buy a mobile trading kiosk in the form of a Volkswagen T1 van from a man for 685 thousand rubles. She also made a deposit of 479.5 thousand rubles.
According to the terms of the agreement, the parties had to discuss the colors of the lower and upper parts of the van by April 30, 2022. Until June 30, 2022, Rodion Rudenko was supposed to hand over the van to the buyer, but did not do so on time. Mr. Rudenko argued this by saying that there was no additional agreement between the parties on the colors of the van, as required by the main agreement.
In July, Siranush Harutyunyan filed a lawsuit with the Arbitration Court of the Krasnodar Territory demanding to recover from Rodion Rudenko a deposit of 480 thousand rubles, as well as interest for the use of other people’s funds. The court satisfied Ms. Harutyunyan’s claim and collected a deposit and interest in the amount of 27.5 thousand rubles from the seller.
Mr. Rudenko appealed the court’s decision to the Arbitration Court of Appeal in Rostov-on-Don. He claims that there was no document agreeing on the colors of the van with the buyer. However, the court did not allow his appeal, considering the “thumbs up” emoji sent by Siranush Harutyunyan on April 6, 2022, as coordinating the colors of the van.
“This sign in the generally accepted and common understanding when communicating via electronic correspondence means ”good,”” the court’s ruling notes.
