Ombudsman Boris Titov notes that “interference from police actions” arises even before the initiation of an administrative case: “The police have the right to appear at the scene of an offense and carry out certain interfering actions, even if the resolution is ultimately signed by another official.” The Business Ombudsman recalls that the relevant powers are spelled out in the Law “On the Police” – and proposes to amend it. Mr. Titov is also concerned that the Ministry of Justice proposes to establish a one-year statute of limitations for bringing to administrative liability under a number of “entrepreneurial” articles. The authors of the draft law explain this by the desire to ensure “an objective and comprehensive consideration of the case.” “But the Law “On State Control” 248-FZ determines that control measures are carried out promptly. It’s unlikely that a period of one year coincides with the concept of efficiency,” concludes Mr. Titov.
