The State Duma immediately adopted in the second and third readings a new law “On Citizenship of the Russian Federation”, which in six months will replace the current law. The list of grounds for deprivation of a Russian passport is expanding. Among them are not only sentences under more than 70 articles of the Criminal Code, but also “commission of actions that pose a threat to national security.” At risk are those who acquired Russian citizenship and those who became Russians as a result of the annexation of Crimea, the DPR, LPR, Zaporozhye and Kherson regions. Russians “by birth” are not threatened by such punitive measures.

A new version of the law “On Citizenship of the Russian Federation” was submitted by President Putin to the State Duma in December 2021, the first reading took place on April 5, 2022. Preparations for the second reading took more than a year – as explained in the Duma Committee on CIS Affairs, Eurasian Integration and Relations with Compatriots, it was necessary to “take into account the situation that has changed after February 24, 2022.” At the plenary session on April 18, the document was adopted immediately in the second and third readings.

Apparently, “taking into account the changed situation”, the most impressive amendments appeared in those articles that talk about the possibility of losing a Russian passport without any desire.

As now, if false information or forged documents were submitted when applying for an intention to become a Russian, this deprives the Russian Federation of a passport. As now, citizenship of the Russian Federation will be taken away from the one who acquired it in the event of the commission of one of the crimes for which the articles of the Criminal Code included in a special list are punished. At the moment, the “old” law “On Citizenship” lists 18 “terrorist” and “extremist” articles of the Criminal Code. The President first proposed to expand this list, adding to it 12 articles – those that punish banditry, organizing a criminal community, organizing mass riots, treason, espionage, as well as a number of “drug” crimes. By the second reading, a group of senators introduced an amendment, supported by the relevant committee, which added more than 50 offenses to the list. But in the end, the authorities tempered their appetites and changed their minds about taking away passports from those convicted of murder, intentional bodily harm, kidnapping, aggravated hooliganism, piracy, robbery, robbery, extortion and bribery.

As a result, we settled on 74 articles (in whole or in part). Among them are those punishing for participation in mass riots, public calls for separatism and extremist activities, the rehabilitation of Nazism, for discrediting the Armed Forces and organizations assisting them, for fakes about the army. And also for sabotage, desertion, indecent acts against minors, repeated violation of the rules for holding mass street events …

The first deputy head of the Committee for CIS Affairs, Konstantin Zatulin (ER), at the plenary session, drew attention to the fact that the threat of losing the Russian passport hung over those “who came along with Crimea, Donetsk, Lugansk.” “This is excessive: if a person has committed a crime, he should be in prison, and then he comes out of prison and is already a stateless person,” he said. But the Duma supported the text of the law exactly in the form proposed by the committee.

Citizenship in connection with the commission of crimes will terminate “regardless” of when the crime was committed, and on when the conviction of the citizen was passed, and regardless of the date of the person’s citizenship. A copy of the verdict that has entered into legal force within five days will leave the court for the Ministry of Internal Affairs, where they will draw up the appropriate decision.

On this basis, a fairly large number of Russians may lose their Russian passports, because since 1992 about 15 million people have acquired Russian citizenship. Moreover, the number of those annually convicted under some of the articles of the Criminal Code included in the list is quite large. For example, Article 228, which punishes the illegal acquisition and possession of narcotic substances without the purpose of sale: according to the Judicial Department of the Armed Forces, in those parts of it included in the list, in 2022 more than 22 thousand people were convicted in Russia. What part of them acquired the citizenship of the Russian Federation is unknown.

No reservations that it is impossible to take away the passports of the Russian Federation from those who do not have another citizenship are made in the law. This means that some of them will become stateless with all the ensuing consequences.

There is in the new law “On Citizenship …” and a completely new basis for the termination of citizenship: “commission of actions that pose a threat to the national security of the Russian Federation.” The FSB will issue its opinion on the “fact” of such actions, send it to the Ministry of Internal Affairs within three days, and that’s it. When actions threatening the security of the Russian Federation were committed, when the FSB found out about it, it does not matter. In this case, Russian passports will be taken away from those who have acquired Russian citizenship. Committee speaker Artem Turov (ER) explained that a new ground for termination of citizenship is necessary “taking into account the prevailing socio-political situation”, besides, those who have lost their passports are given the right to appeal the decision made against them in court – but later.

Those whose citizenship has been terminated at the conclusion of the FSB will be able to apply for a Russian passport again in three years. If citizenship is terminated for forging documents or providing false information – after a year.
