According to the draft amendments to the law on employment prepared by the Ministry of Labor, operators of digital platforms (such as Yandex or Sberbank) will not be required to make contributions to pension and social funds, reports Vedomosti with reference to sources. However, the Ministry of Labor proposes to provide benefits for those employees of platform operators who voluntarily join social guarantee systems.
“For example, if a self-employed courier has entered into a non-state pension provision or VHI agreement, the platform can set a smaller commission for him compared to the general rule. According to them, this should become an incentive for employees to pay insurance premiums to the funds on their own,” sources told the newspaper.
They also noted that the ministry intends to give operators the right to “apply liability measures.” This wording means the legalization of sanctions for the disruption of paid services or improper performance of duties by employees of digital platforms. The Ministry of Labor proposes to create a special council of digital employment platforms to resolve disputes.
Regulation of the legal status of “platform workers”, that is, citizens working through aggregators and online services, recognized problem in many countries around the world. Most often employed in the platform economy, it is precisely the lack of social benefits that does not suit them.
