As it became known to Kommersant, the government apparatus demanded that six federal departments, which account for the maximum control and supervisory activity, “upload” to the Ministry of Economy the entire array of data on the inspections they have carried out since the entry into force of the new law on CND. The data was needed by the White House to explore the possibility of managing the effectiveness of control and oversight through the regulation of risk assessment and indicators, which agencies use in a risk-based approach to inspections. The Ministry of Economy should propose models of such management, and then test their effectiveness on an array of inspections that have already taken place, in order to find out whether it is possible in principle to reduce the number of violations by refining departmental risk maps and how this process should be optimized.
The order of the head of the government apparatus in charge of the control and supervisory reform, Deputy Prime Minister Dmitry Grigorenko, dated August 22 (Kommersant has it), requires six federal departments – the Ministry of Emergency Situations, Rosselkhoznadzor, Rospotrebnadzor, Rosprirodnadzor, Rostrud and Rostekhnadzor – “until August 24 » uploading to the Ministry of Economy of detailed “information on the most massive violations of mandatory requirements identified from July 1, 2021 to July 31, 2022 during the implementation of types of state control (supervision)” and “proposals to introduce new risk indicators for them”, but from the Ministry of Economy itself — analysis of the submitted data and proposals to the government based on its results. The White House staff confirmed the authenticity of the document, explaining that its purpose is to provide data for the beginning of a new stage in the regulation of control and supervisory activities.
Recall that the concept of the reform of state and municipal control and supervision involves focusing the attention of controllers on areas of high risk of violation of mandatory requirements for business while continuously updating the requirements themselves – for this, new control and supervisory standards should be introduced only on September 1 and March 1, and the departments themselves should to review its requirements annually for compliance with industry risks. In 2021 (the year the law on control was adopted), 882,000 business inspections were carried out against 1.5 million in 2019 (the data for 2020 and 2022 are not comparable due to the imposed moratoriums – “covid” and “counter-sanctions”). At the same time, in 2021, a sharp decline in the number of control measures was recorded after July 1 (the date the law was adopted) – in the second half of the year, 266 thousand inspections out of 882 thousand were carried out.
The idea of the White House apparatus, which is intended to be implemented by Mr. Grigorenko’s order, is to study the impact on the results of CND of fine-tuning the “risk maps” that inspectors are guided by when inspecting companies — de facto, we are talking about expanding the tools for intelligent regulation of all control activities. The White House staff confirmed to Kommersant that six out of 34 departments were selected for data collection, which account for the most massive types of state control (65% of all inspections), while we are talking only about data from inspections of federal departments – this should provide the Ministry of Economy with a homogeneous array data, since regional and municipal controllers often act according to protocols that differ from subject to subject of the Russian Federation. It is assumed that the experiment will not affect the current relations between controllers and business in any way and will not affect the operation of markets: the management models of the Ministry of Economy will be tested on historical data, assessing how they would be affected by this or that change in the approach to choosing control targets and, in particular, allows whether it can reduce the number of violations of mandatory requirements themselves (let us recall that the requirements that cause mass violations are problematic in the logic of the reform and require a separate analysis of their expediency).
If the experiment turns out to be fruitful, it is logical to assume that it will be extended in one pilot mode or another and to the real work of controllers: this may give the White House the opportunity to take into account, when fine-tuning CND, not only the interests of specific departments and businesses, but also the “federal”, general economic risk map. Now, let us recall, controllers have complete independence in choosing the objects and goals of inspections, and there is no de facto mechanism for centralized adjustment of its work depending on the economic and political situation, while in an unstable environment the real “risk map” is often better visible from the top level. executive power.
