The State Duma approved amendments that increase the threshold values ​​for large and especially large amounts of damage (income, debt) for crimes of economic activity. Bill introduced back in April 2023, it was greatly improved by the second reading.

The threshold for qualifying significant damage for fraudulent actions (Article 159 of the Criminal Code of the Russian Federation) associated with deliberate failure to fulfill contractual obligations will be increased from 10 thousand to 250 thousand rubles, for a large amount – from 3 million rubles. up to 4.5 million rubles, for especially large ones – from 12 million to 18 million rubles. The threshold for large-scale illegal issuance of consumer credits (loans) will be raised from 2.5 million to 3.5 million rubles.

If banks conceal information about placed deposits of individuals and individual entrepreneurs, the threshold for a large amount within one year will increase from 3 million to 4.5 million rubles. The amount of income on a large scale when determining the penalty for restricting competition will increase from 50 million to 80 million rubles, income on an especially large scale – from 250 million to 395 million rubles. Major damage will be considered not 10 million, but 16 million rubles, and especially large damage – not 30 million, but 47.5 million rubles. The amount of major damage when punished for illegal use of someone else’s trademark will increase from 250 thousand to 400 thousand rubles.

The amount of major damage in case of violations of the procedure for recording rights to securities and restrictions on the rights of their owners will increase from 1.5 million to 2.5 million rubles, for especially large ones – from 3.75 million to 5.5 million rubles. The threshold for major damage in case of malicious evasion of disclosure or provision of information under the law on the securities market will be not 1.5 million, but 3 million rubles. In case of unlawful use of insider information, the threshold for major damage will be increased from 3.75 million to 5.5 million rubles. The large-size threshold for illegal transfers of foreign or Russian currency (once or repeatedly during the year) will be increased from 9 million to 13 million rubles, for an especially large amount – from 45 million to 65 million rubles.

The explanatory note states that the thresholds for determining penalties need to be revised due to inflation. New limits will come into force ten days after official publication, except for limits in the field of customs payments and duties – they will come into force after 90 days.
