The State Duma proposed to raise the bar for determining the damage from economic crimes

State Duma deputies Alexei Nechaev, Vladislav Davankov and Alexander Demin (the New People party) will introduce a bill to increase the parameters for determining large and especially large damage under the economic articles of the Criminal Code of the Russian Federation. Amendments are being made to a number of articles of the Criminal Code of the Russian Federation. In particular, Art. 170.2 (introduction of deliberately false information into the boundary plan, technical plan, act of survey or map-plan of the territory), the deputies propose to increase the amount of major damage from 2.25 million rubles. to 3.5 million rubles, and a special large – from 9 to 13.5 million rubles.

In the text of Art. They want to increase income on a large scale from 50 to 80 million rubles, and on a particularly large scale – from 250 to 395 million rubles. At the same time, the amount of major damage will increase from 10 to 16 million rubles, and the amount of special large damage – from 30 to 47.5 million rubles.

Deputies propose to make similar changes to Articles 180, 199, 199.1, 199.3 and 199.4 of the Criminal Code of the Russian Federation.

In the explanatory note, the authors of the bill note that it is necessary to raise these values ​​taking into account inflation. According to them, the amount of large and especially large damage under the economic articles of the Criminal Code has not been indexed for a long time, which led to a decrease in the “degree of social danger of a crime.”

The deputies also point to the statement of Russian President Vladimir Putin, made in March 2022, when the head of state called for “maximum economic freedom” for business against the backdrop of anti-Russian sanctions.

In July 2022 Putin instructed the government and the Supreme Court to amend the legislation to decriminalize certain crimes in the field of entrepreneurship. In August, the Ministry of Justice prepared amendments to the Criminal Code of the Russian Federation, according to which it is proposed to abolish criminal liability for doing business without registration and to increase, taking into account the level of inflation, the levels of significant, large and especially large damage.

During his address to the Federal Assembly in February 2023, the President of the Russian Federation again urged to revise some norms of the Criminal Code on the economic components of crimes. “Of course, the state should control what is happening in this area. Permissiveness cannot be allowed here, but there is no need to go too far either, ”he stressed.
