The prosecutor’s office took “Volzhsky orgsintez” in favor of the state – Kommersant

The Arbitration Court of the Volgograd Region just a month after the filing by the Prosecutor General’s Office lawsuit on the withdrawal of 100% of the shares of the chemical enterprise Volzhsky Orgsintez JSC completed the consideration of a high-profile case, in fact, at a single meeting. On August 24, at a meeting that lasted more than five hours, the court fully satisfied the claim and decided to withdraw 2,344,925 shares of the enterprise for crediting them to the account of the Federal Property Management Agency.
Recall that the supervisory authority stated that “the Russian Federation, as the owner of a state-owned enterprise, did not privatize it, did not transfer the authority to own, use and dispose of this property of the Volgograd Region.” At the same time, the State Property Fund of the Volgograd Region in the period from September 1993 to 1996 “illegally distributed property belonging to the Russian Federation in the form of securities, transferring them to third parties, including residents of foreign states.”
Representatives of the current owner of the enterprise, Alexander Sobolevsky, and the plant itself filed more than a dozen petitions, none of which were satisfied by the court. Among other things, the defense of the beneficiary of Volzhsky Orgsintez demanded that former officials who were involved in the decisions on the basis of which the privatization was carried out be called witnesses in court. Among them are not only the former heads of the Volgograd authorities, but also the ex-head of the State Property Committee Alfred Kokh.
The court also rejected the proposal to postpone the meeting until Mr. Sobolevsky’s lawyers received answers to lawyer requests that his representatives sent to a number of state structures – from the Russian government to the Volgograd Regional Duma. The arguments of the defense about the expiration of the statute of limitations did not help either – representatives of the plant provided evidence that various government agencies, including the prosecutor’s office of the Volgograd region, had known the fact of distribution of shares between individuals at least since the beginning of the 2000s. However, the representative of the Prosecutor General’s Office insisted that the period should be calculated from the time when it became known about the fact of the illegal act of “privatization, which did not happen, could not happen”, and immediately after this fact was established, the Deputy Prosecutor General filed a lawsuit.
Recall that the Volga enterprise has long been the largest producer of aniline in Russia. This substance is used as a raw material for other chemical products such as herbicides, but also for military purposes. In 2020, Volzhsky Orgsintez stopped the production of aniline due to unprofitability. Now Russia is buying this raw material from China.
Representatives of Alexander Sobolevsky will appeal the decision of the Volgograd arbitration.
