The Ministry of Industry and Trade wants to return quality control of industrial products to Rosstandart

Against the background of growing demand for Russian products and the restructuring of supply chains, the Ministry of Industry and Trade proposes to introduce a new type of state supervision in the Russian Federation – over the circulation of industrial products in order to control its quality. So the department intends to fight against unsafe and counterfeit products – after the reform of control and supervision activities (CND), a number of its types are not subject to state control. It is proposed to Rosstandart to carry out supervisory functions, which previously had this experience – however, the previous attempts to return the authority to the service were unsuccessful.
The Ministry of Industry and Trade published on regulation.gov.ru a draft amendment to a number of laws on the introduction of a new type of state control – for compliance with mandatory requirements for industrial products. The ministry explains the need for this by the fact that after the CND reform in 2022, a number of goods that are covered by 13 of the 46 technical regulations of the EAEU, as well as those included in the list of products subject to mandatory certification and declaration of conformity, are not covered by control. At the same time, the demand for products for the needs of domestic consumers has increased significantly due to sanctions. As a result, business communities note “the growth of negative trends in connection with the circulation of unsafe and counterfeit products on the Russian market,” the materials for the project say.
Recall that on July 1, 2021, Law 248-FZ on state control, which is the “procedural” part of the CPV reform, is in force in the Russian Federation. It provides for the focus of controllers only on areas of high risk of violation of mandatory business requirements while continuously updating the requirements themselves. New mandatory requirements can be introduced only from March 1 and September 1. The explanatory note to the amendments of the Ministry of Industry and Trade does not contain an explanation of what prevents customers from simply not buying low-quality products – and what caused the first abolition of state control of industrial products as part of the reform, and now its return. Moreover, the idea to return control was introduced to the government apparatus supervising the CPV reform since the fall of 2022 several times, but was not supported, the project materials say.
The Ministry of Industry and Trade refers to the instruction of President Vladimir Putin following the results of the April meeting of the State Council “to consider before September 1, 2023 the possibility of applying a risk-based approach to state control over compliance with the mandatory requirements of technical regulations in relation to industrial products” and the instruction of Deputy Prime Minister, head of the Ministry of Industry and Trade Denis Manturov. It is assumed that Rosstandart, subordinate to the Ministry of Industry and Trade, will exercise supervision. As the ministry explained to Kommersant, before the reform it was carried out by Rosstandart, and it “has retained both the infrastructure (interregional territorial departments), and supervision specialists, and experts.” It is planned that the return of state supervision over the turnover of industrial products will take place from March 1, 2024.
The ministry expects that the introduction of a new type of state control will not cause a slowdown in supplies, but rather “protect the market from unfair competition and create conditions for the development of domestic industries”, and note that the initiative was supported by the RSPP, the Chamber of Commerce and Industry, associations of cement producers, radiators, etc. The materials to the document note that, according to preliminary estimates, damage to various industries (cement, steel pipes, bearings, heating radiators, electrical engineering, and others) from low-quality products can reach 170 billion rubles. in year.
