The Ministry of Economy will assess the need to maintain tax preferences for participants in Russian offshore companies – special administrative regions (SAR). To do this, the ministry proposes to introduce five criteria for evaluating the effectiveness of benefits received by residents of these territories (taking into account the feasibility and effectiveness of tax expenditures). Among them is compliance with the goals of the socio-economic development of the regions and being in demand by business. This follows from the draft order on the approval of the methodology for assessing the effectiveness of tax expenses associated with the use of reduced income tax rates by international holding companies (IHC) – members of the SARs (Vedomosti got acquainted with it).
The main tax incentives for SAR participants are reduced income tax on income in the form of dividends, interest and royalties. The rate for MHC is 5%. The rate for distribution of income abroad is 10%. To receive benefits, you need to invest 300 million rubles. in the construction of social, transport, energy and engineering infrastructure in the SAR region for three years. The company must comply with the substance requirement (economic and physical presence of the company in the jurisdiction) – to hire from 15 employees and rent an office from 50 sq. m.
