The court returned about 1% of the Gubakha Metafrax to the state – Kommersant

The Arbitration Court of the Perm Territory today fully satisfied the claim of the Prosecutor General’s Office of the Russian Federation to recover 2,124,000 shares of Gubakha-based Metafrax Chemicals from JSC Togliattikhimbank. The decision on this was published in case card.
Let us recall that the court, as part of the consideration of the claim of the Prosecutor General’s Office for the recovery of 100% of the shares of Metafrax Chemicals in favor of the Russian Federation, at the request of the supervisory authority, separated into separate proceedings the claims against one of the defendants – Togliattikhimbank (owned less than 1%).
The bank indicated that it was a bona fide purchaser of shares in the Gubakha chemical plant. But according to the prosecutor’s office, on the day the claim was filed, the defendant alienated shares to the fly-by-night company LLC Ecological Recreation Center Vostok (registered in the village of Turovo (Serpukhov, Moscow region) for 300 million rubles. At the same time, the shares remained pledged from the bank. According to the supervisory authority, these actions are aimed at a formal change of owner and are unfair.
September 8, Arbitration Court of the Perm Territory satisfied a lawsuit by the Prosecutor General’s Office of the Russian Federation for the seizure of almost 96.15% of the shares of Metafrax Chemicals JSC, which belonged to Metaholding JSC and Metafrax Trading LLC, to the income of the Russian Federation. Only one hearing on the merits was required to reach a decision in the case.
During the trial, the prosecutor’s office argued that the plant in Gubakha was not subject to privatization at all, since it produced methanol, which is a toxic substance. The enterprise is also strategic, so permission for privatization had to be given by the government of the country, but it occurred due to the illegal actions of Perm officials. The defendant insisted that methanol at that time was not formally a poison, and privatization took place under the full control of the State Property Committee of the Russian Federation.
