The court declared illegal the decision of the Federal Antimonopoly Service to impose a fine on T Plus

The Moscow Arbitration Court declared the fine imposed by the Federal Antimonopoly Service (FAS) on the generating company “T Plus” invalid, about this informed “Interfax” with reference to the materials of the case, placed in the file of the court.

“T Plus” in court tried to challenge the decision of the FAS to impose a fine on the company in the amount of 846.5 million rubles. in the case of price manipulation in the wholesale electricity and capacity market, which was initiated in relation to the company’s actions in the period from February to April 2019. In December last year, the FAS found T Plus guilty in this case.

FAS figured outthat the price bids of the company turned out to be higher than the actual costs of electricity generation by an average of 70-90%, “and in some cases more than 2 times.” Such steps had an impact on the equilibrium price for electricity in the Vyatka free flow zone of the first price zone, where T Plus occupies a dominant position. As a result, such pricing was reflected in the final cost of electricity in the wholesale energy market. According to the department, these actions led to additional costs for consumers in the amount of more than 66.8 million rubles. per month.

In “T plus” did not agree with the accusations of the FAS. The company noted that it received one request from the supervisory authority back in 2019 and even then gave the necessary explanations.
