The Russian government has proposed increasing the damage threshold for crimes related to evasion of mandatory payments to the budget by 25% (Articles 199, 199.1, 199.3 and 199.4 of the Criminal Code), they report “Vedomosti” with reference to a source in the government commission on legislative activities and RBC with reference to materials for the bill.

According to publications, the legal commission proposed amending the bill to increase the threshold values ​​for determining large and especially large damage under economic articles of the Criminal Code. This bill was adopted in the first reading in May 2023. In addition to amending the above articles, it also affects Art. 170.2, 178, 180 CC.

Vedomosti’s interlocutor said that the government wants to raise the large-size threshold from 15 million to 18.75 million rubles. and especially large size from 45 million to 56.25 million rubles. under articles on tax evasion (Article 199 of the Criminal Code) and failure to fulfill the duties of a tax agent (Article 199.1 of the Criminal Code).

In addition, according to the source, the Cabinet of Ministers plans to increase the same limits for articles on evasion of insurance premiums by an individual (Article 199.3 of the Criminal Code; from 1.8 million to 2.25 million rubles and from 9 million to 11.250 million rubles. respectively) and evasion by the insured organization (Article 199.4 of the Criminal Code; from 6 million rubles to 7.5 million rubles and from 30 million rubles to 37.5 million rubles).

The amendments also included a proposal by the Legal Commission to increase the thresholds under articles of the Criminal Code 159 (fraud), 178 (restriction of competition), 193 (evasion of obligations to repatriate funds), 194 (evasion of customs duties and duties), 200.3 (raising funds from citizens in shared construction).
