State industrial facilities of the ASEZ will be transferred to management companies and residents

The Ministry of Economy has developed a procedure for transferring movable state property to management companies (MCs) of priority development territories (ADTs) for its subsequent transfer to residents. We are talking about situations that arise when areas with industrial facilities withdrawn from the production process are included in the boundaries of a priority development area. Residents of territories, having received, for example, equipment along with real estate, can use it to implement their investment projects.

The Ministry of Economy has prepared a regulatory framework for launching a mechanism for transferring state-owned movable property to management companies of priority development areas in the Far East, the Arctic and closed administrative-territorial entities (CLATEs), for its subsequent transfer to residents. Lawallowing for such a possibility (before this it was only about real estate), was adopted at the end of February.

Let us clarify that the property in question appears when areas with industrial facilities or workshops removed from the production process are included within the boundaries of the ASEZ. For example, as noted in the Ministry of Economy, such a situation occurred during the creation of the ASEZ of the nuclear industry. “Industrial buildings are equipped with equipment that is classified as movable property; it has been transferred into municipal ownership by the city-forming enterprises of the CATU,” the department explained.

As follows from the draft government resolution developed by the Ministry of Economy, movable property, by analogy with real estate, will be transferred by the Russian Federation, regions or municipalities in favor of management companies – for rent or ownership.

The management company can dispose of the received property and lease it to residents of the priority development area. It is also possible for a resident to obtain ownership rights to such property – after fulfilling their obligations to make investments, the equipment rented from the management company can be purchased.

As Nikolay Pegin, general director of Atom-TOR, previously explained, “having received movable objects along with the premises, residents can avoid spending money and time on dismantling and use them in the implementation of their projects.”

As AKIT director Mikhail Labudin notes, “if the management company cannot dispose of property located in the territory of a priority development area, then administrative barriers arise in providing the investor with the necessary property.” He sees only advantages in the opportunity to receive and transfer “movable property” to residents and hopes that this will speed up the process of filling ASEZ with new projects.
