Senator Klishas explained why Putin did not issue a decree on the end of partial mobilization

On amendments to the Criminal Code and the Code of Criminal Procedure, exempting from punishment for crimes committed on the territory of new regions: “If before September 30 of this year (the date of acceptance of the LPR, DPR, Kherson and Zaporozhye regions into the Russian Federation. — Note. “MK”) law enforcement agencies of Ukraine initiated criminal cases on the territory of these regions under the article “Treason against Ukraine” against persons who objectively defended the Russian-speaking population, such cases are subject to termination. If murders have been committed there, they must be investigated. Not every crime is covered by these amendments.”

On the return of the death penalty: “The constitution makes no exceptions for martial law or national security interests. For some reason, the media have a desire to constantly discuss some hot topics. There is a very clear answer given by the chairman of the Constitutional Court of the Russian Federation: the constitutional legal regime does not allow a return to the death penalty. This has nothing to do with Russia’s membership in the Council of Europe. To return to the discussion of the death penalty in legal terms is possible only if a new Constitution is adopted. The President said that he agreed with this position. What is the point of asking me this question once a week?”

On the adopted “mobilization” package of laws and the need to develop wartime legislation: “We don’t have laws for wartime. We don’t even have wartime. This is not because the authorities want to play with words.

Wartime implies a serious restriction of rights and freedoms within the framework of the Constitution. Therefore, we treat the topic of wartime legislation very carefully. The desire to create wartime legislation was never formulated by the President. Although it would be nice to have an array of laws for such a case. We don’t have it.

We have made targeted changes to the Criminal Code, which are applied during the period of hostilities, mobilization, in the zone where the SVO is taking place. This is an urgent need. The task is to protect the civilian population from crimes, in particular from looting. We still remain in the concept of a point change in the law.”

On the need to tighten control over refugees from Ukraine: “You must always proceed from what goals you have. If it is necessary to carry out control by the state security agencies and the police over persons who arrive on the territory of the Russian Federation, including legally, we look at the statistics and see that the number of solved crimes is growing. That is, the state security agencies perform their function.

The problem is that the receiving party – the citizens of Russia themselves – do not always fulfill their obligation to register citizens of Ukraine with them. But we proceed from the fact that by accepting refugees, we must protect these people who find themselves in a very difficult situation. The task is to provide them with everything necessary so that these people can get a job, their children can go to kindergarten or school. This does not cancel the control of persons who come to Russia with bad intentions.”

On measures to support the mobilized: “We have these questions at every plenary session. The number of laws that have been introduced on this issue – starting from special rules for the execution of court decisions, business management issues while a person is in the ranks of the RF Armed Forces – there are a lot of such issues. From the point of view of the peculiarities of the execution of court decisions in relation to mobilized citizens, all these laws have been adopted. There remains the issue of pensions. It is necessary to continue to pay pensions to military pensioners. Now they stop paying if a person was called. Appropriate amendments are needed, this will be done in the near future.

About the zero mortgage rate for large families: “That is not my question. Whether banks can issue loans at a zero rate or not, whether this will require subsidies from the budget – all this must be carefully analyzed. This is zero for a person. But someone still has to pay for this loan. Just to say that I support this, so banks can complicate the procedure for issuing mortgages for large families so much that it would be better if such provisions were not adopted at all. To say “I am for everything good and against everything bad” is not a lot of mind.”

About the ban on working remotely for those who left Russia: “The draft law, prepared by me and deputy Andrei Isaev, states that the specific list of specialties for which it is impossible to work remotely is determined by the Cabinet. This is all related to the safety of citizens. Tomorrow or the day after tomorrow we will finish the technical things and send the draft law for review to the government, after which we will submit it to the State Duma.

Let’s think about the safety of the people who live in the country. We use trains, planes, depend on infrastructure. If a person is abroad and has access to the internal networks of such companies, this creates risks for citizens.

What are some ways we can minimize this risk? What guarantees are there that the person who signed the employment contract is behind this computer?

I also do not think that we should create preferences for citizens who fled abroad from mobilization. I am assured that these citizens are the most creative, they will find work everywhere. Well, that’s great, work all over the world. If you want – come back here, if you want – work abroad, if you really have such a qualification that allows it. We will be glad if you return. According to the Constitution, we cannot restrict a person’s right to return in any way. But why should we be indifferent to the risks that arise if people work remotely from abroad in certain specialties? Suggest us another way and we’ll see if it works or not. So far, we don’t see any other way.”

On the expiration of the terms of mobilization and the absence of a corresponding presidential decree: “I don’t understand why you are so interested in whether there is a decree or not. A decree that would terminate the operation of partial mobilization is not provided for by any law. That’s why it doesn’t exist.

Partial mobilization is not only the conscription of people into the army. This is also a whole range of measures for the industry, the extension and conclusion of contracts – all these rules continue. Mobilization as a conscription of citizens for military service is completed. The President put an end to this issue. The power of the President’s word is higher. Do you think that it is impossible to cancel one decree and accept the next one? What is the problem here?

The President is empowered by the Constitution as Supreme Commander to issue decrees. It can be one decree, five, ten… But when the president comes out and says openly that the partial mobilization has been completed, it seems to me that this has much more power. The society had a question – the president brought his position to the citizens in the most effective way. If a decree had been issued, but he had not spoken to journalists, people would have said: “Whoever reads decrees there, let him come out in front of the cameras and say whether it is completed or not.”

On the protection of personal data of citizens: “This topic is very difficult for us. Including due to the opposition of the industry lobby. Mintsifra – against the introduction of turnover fines. We stand for; we are also for the introduction of even criminal liability for leaks of personal data. We have good support from the HRC. Turnover fines are the most promising measure.

But I am a supporter of criminal liability for leaks. If you work, are a professional market participant, it is solely a matter of investment in security issues that the company must make. If a crime has been committed against a company, and it is not guilty, then there are no questions. But if a company is careless about security issues, and data is constantly leaking to the black market, that is the responsibility of the company.”
