Senator Klishas calls criminal liability for evasion of mobilization irrelevant

Andrey Klishas, ​​head of the Federation Council Committee on Constitutional Legislation and State Building, wrote in Telegramthat once partial mobilization is completed, then criminal liability for evading it is irrelevant. At the same time, he called the absence of such an article in the legislation “an obvious gap.”

Earlier today, deputies and senators from United Russia developed draft law on criminal penalties for mobilization evaders. They suggested punishing evaders with a fine of 200,000 to 500,000 rubles. or in the amount of income for one to three years, as well as forced labor or imprisonment for up to five years.

Partial mobilization in Russia was carried out from September 21 to October 28. The Ministry of Defense stated that 300 thousand people were drafted into the army. On October 31, President Vladimir Putin confirmed that the mobilization was “completed, the end has been set.” At the same time, the Kremlin believes that a separate decree completing the mobilization is not required.

During the call-up of reservists in Russia, there were excited one criminal case on evasion of mobilization (under part 1 of article 328 of the Criminal Code of the Russian Federation). A few days later, the prosecutor’s office canceled the decision to initiate proceedings.
