RSPP proposed to establish a moratorium on the growth of state land lease rates

President of the Russian Union of Industrialists and Entrepreneurs Alexander Shokhin proposed not to increase the cost of renting state-owned land plots, while increasing its cadastral value in 2023. The corresponding proposal is contained in a letter to First Deputy Prime Minister Andrey Belousov dated December 19, available RBC.
The rental rate for land that a company leases from the state can be determined both based on the cadastral value and other indicators. For example, the rate can be set as a result of bidding. The cadastral value affects not only the rental rate of state land, but also the tax that must be paid to the owners of the plots. A moratorium has already been established on the growth of the tax base for land plots next year, recalls Mr. Shokhin and suggests that in the event of an increase in the cadastral value of land, the calculation of the rent should be based on the cadastral value that was in effect as of January 1, 2022.
The revision of the cadastral value of land takes place every two to three years in each region separately. There is no exact data on how many percent of tenants now pay rent for state plots based on the cadastral value, Roman Gusak, lawyer at Forward Legal, explained to the publication.
“For many manufacturing companies, an increase in the amount of lease payments means a significant increase in the financial burden, which in today’s conditions threatens their further functioning,” the president of the RSPP notes in a letter.
