Rosreestr proposes to transfer the authority to carry out all complex cadastral works at the expense of the federal budget to the public law company (PPK) Roskadastr. Now the regions receive subsidies for these purposes, and the work is carried out by market players under government contracts, but Rosreestr is dissatisfied with the results. They point to the low level of qualification of both state customers and contractors – as a result, the budget suffers losses, and the filling of the Unified State Real Estate Register (EGRN) is lagging behind, which affects the development of territories and their investment attractiveness.

Rosreestr proposes to transfer the implementation of complex cadastral works at the expense of the budget to the PPK Roskadastr – the draft amendments to the law “On cadastral activities” are published on regulation.gov.ru. The service believes that this will create a comprehensive system of measures to clarify information about real estate objects, correct registry errors, fill the USRN with data, identify unregistered objects and fill the federal spatial data fund.

The government created Roscadastre in 2021 as a full-cycle state-owned company just to provide comprehensive services in the field of real estate and spatial data (the goal of the state program is to create a multi-layer digital map of the Russian Federation and eliminate the problem of incomplete data on land and real estate). Now the USRN contains more than 8.5 million registry errors, also 22 million land plots (35.5%) and 31 million capital construction facilities (71.5%) do not have the exact location of their borders, and by 2030 the USRN should have at least 95% complete and accurate information.

Rosreestr itself is the main manager of budget subsidies to the regions for comprehensive cadastral work (in 2023 it is 509.7 million rubles, in 2024 – 541.9 million, by 2025 the amount will rise sharply to 9 billion rubles). In the new design, it is proposed to directly appoint Roskadastr as the recipient of the subsidy, since Rosreestr is not satisfied with the quality of the implementation of complex cadastral works in the current scheme. The Law on Public Procurement (44-FZ) provides for a competitive selection of contractors for complex cadastral works (CCR), but the authors of the project note the low qualification of procurement specialists in the regions: during the auction, the price can be reduced by up to 80%, customers conduct new competitive procedures with the money saved , but not all regions can master the allocated funds, and budget legislation does not allow them to be quickly redistributed among the constituent entities of the Russian Federation. At the same time, the regions regularly apply to Rosreestr and the Ministry of Finance for the restoration of funds to pay for contracts of previous years.

It is also not possible to complete cadastral work on time: for example, in 2022 it was necessary to complete them by May, but purchases of services in 23 out of 30 regions continued in the summer. Bidding is won by cadastral engineers and legal entities that do not provide the preparation of documents of proper quality. As a result, most of the map plans of the territories are repeatedly reviewed by Rosreestr and returned for revision. So, in the Magadan region, the data of cadastral work in 2019 were finally entered into the USRN only in 2022. As the authors of the project point out, Rosreestr sent to the regions a standard terms of reference for the implementation of QRC, taking into account possible errors, but not all regions use it.

All this leads to inefficient spending of funds and an increase in the risks of non-fulfillment of the state program, and the lack of spatial data also negatively affects the socio-economic development of the territories. The reliability of USRN information minimizes the risks of territorial disputes and court costs, the uncertainty of legal regimes for the use of real estate, and also improves the quality of planning and management of territories. Having branches in the regions, the PPC will be able to flexibly distribute resources for cadastral work between them, and will also control the quality and timing of the work, Rosreestr calculates.
