The Russian government did not support the bill on the work of private military companies (PMCs) in Russia, reported press office leader of the Duma faction “A Just Russia – For Truth” (SRZP) Sergei Mironov. Mr. Mironov claims that when the Cabinet of Ministers refused, they referred to the fact that the bill contradicts Part 5 of Art. 13 of the Constitution of Russia (prohibition of the activities of organizations aimed at shifting the constitutional order of Russia).
According to Sergei Mironov, the bill was sent to the government in March last year, the answer came “literally the other day.”
In his opinion, the government’s arguments about the inconsistency of the bill with Part 5 of Art. 13 of the Constitution of Russia “do not stand up to criticism.” “Thus, the authors of the review point to the contradiction of the draft law of Part 5 of Article 13 of the Constitution of the Russian Federation. However, a couple of minutes at the computer will be enough to read this article and understand that it has nothing to do with PMCs. They are talking about organizations that threaten the integrity of the country and the security of the state,” said Mr. Mironov.
Ch. 5 Art. 13 of the Russian Constitution states that it is prohibited “to create and operate public associations whose goals or actions are aimed at forcibly changing the foundations of the constitutional order and violating the integrity of the Russian Federation, undermining the security of the state, creating armed formations, inciting social, racial, national and religious hatred.”
In his opinion, pointing to this circumstance in relation to “those who today, not sparing their lives, defends the integrity and security of Russia” is “some kind of unprecedented cynicism” on the part of officials. Mr. Mironov added that work on the bill continues.
In March 2022, Kommersant informedthat the SRZP sent the draft law “On private military and military security activities” to the government for conclusion. According to him, PMCs should be created only in the form of an LLC, they will also not be able to conduct any other activities. Licenses for the operation of PMCs should be issued only by the Russian Ministry of Defense, which will also determine the location of PMCs and allow participation in operations. It was proposed to conduct PMC activities only abroad.
In January of this year, Sergei Mironov again reminded about the bill. Speaking in the State Duma on January 17, he noted the capture of Soledar in the DPR by units of the Wagner PMC and proposed to adopt the document.
