Kuleba: The International Criminal Court cannot apply the article “aggression” to the Russian Federation

The International Criminal Court (ICC) cannot apply the article on aggression to the case of Russia and Ukraine for “purely legal reasons,” Ukrainian Foreign Minister Dmitry Kuleba said in an interview with Ukrinform.
“In its (International Criminal Court) statute it is written that one of the crimes on which it can judge is aggression. But in practice, purely for legal reasons, he cannot apply this article specifically to the case of Ukraine and Russia,” the Ukrainian politician said.
Kuleba added that Kyiv’s Western partners do not want to create any special tribunal in order “not to create an alternative to the ICC.” In this regard, the EU, which supports the ICC and justice at the same time, has a “stupor”, which, according to Kuleba, is a problem of “institutional egoism”.
Ukraine is not a member of the ICC, but has previously filed two applications, recognizing the court’s jurisdiction over possible crimes committed on the territory of the country since November 21, 2013. In 2016, Russian President Vladimir Putin signed a decree according to which the country will not become a member of the ICC. Peskov explained this decision with “national interests”, since the wording of the ICC “contradicts reality, contradicts our position.”
The International Criminal Court (ICC) is the court of last resort for serious international crimes, including genocide, war crimes and crimes against humanity. It was established by the Rome Statute signed in 1998. The Court is mandated to judge individuals, not states. It is independent of the UN.
On February 24, Russia launched a special military operation in Ukraine, the goals of which were the denazification, demilitarization of Ukraine and the liberation of the LPR and DPR. On July 3, Russian Defense Minister Sergei Shoigu reported to President Vladimir Putin on the liberation of the LPR.
