Klishas reminded new subjects of the moratorium on the death penalty

The head of the Constitutional Committee of the Federation Council Andrey Klishas said that the new subjects of the Russian Federation must comply with the Constitution, including on the issue of the death penalty. He recalled that the martial law in the region is not the basis for lifting the moratorium on the death penalty. Earlier, representatives of local authorities spoke out for the introduction of the death penalty in the Zaporozhye region.
“Martial law in the region cannot be the basis for the abolition of the moratorium on the death penalty on its territory. Constitution and decisions of the Constitutional Court (Constitutional Court.— ”b”) do not know such exceptions. The Constitution of Russia must be observed by everyone, including the new subjects of the Russian Federation,” Mr. Klishas wrote in his Telegram channel.
On January 16, Acting Governor of the Zaporizhzhya Region Evgeny Balitsky on the air of the Krym 24 TV channel spoke for the introduction in the region of the death penalty for especially serious crimes. A similar statement was made on the same day by Volodymyr Rogov, a member of the main council of the administration of the Zaporozhye region. On the radio station “TVNZ” he stated that the death penalty in the subject’s territory is “necessary, all the more so in combat conditions.”
Before joining Russia, the death penalty as the highest form of punishment existed in the Donetsk People’s Republic. On October 2, 2022, the Constitutional Court of the Russian Federation clarified that the norms of legislation that contradict the Constitution will not be applied in the territories included in it. In the republic, the highest measure replaced to life imprisonment. In the summer in the DPR, the British Aiden Eslin and Sean Pinner and the Moroccan Saadun Brahim were sentenced to death, who were accused of participating in hostilities on the side of Ukraine as mercenaries. On September 21, they were taken to Saudi Arabia and released.
December 8 Deputy Chairman of the Security Council of the Russian Federation Dmitry Medvedev offered “overcome the moratorium” on the death penalty for saboteurs. Then Mr. Klishas, commenting on the words of the politician, said that a return to the death penalty in Russia under the current Constitution is impossible.
