The Oktyabrsky District Court of the Chelyabinsk Region ordered the draft board to reconsider its decision to call up citizen Yevgeny Kurchatov, the father of three children under the age of 16, taking into account new instructions from the General Staff, reports RBC.
According to the conscript’s wife, the couple provided the commission with all possible information, including that the man works for a cleaning company and that he has three dependent children, but this did not affect the commission’s decision. Then there was an appeal to the court with a demand to recognize the decision to mobilize illegal.
Meanwhile, on October 13, the State Duma reported that the Ministry of Defense had adjusted the requirements and given the right to deferment to those fathers who have three children.
Taking into account the new instructions, the court of the Chelyabinsk region considered the lawsuit appealing against the mobilization of Kurchatov.
The court refused to satisfy the initial demand – the decision was made by the draft board even before the new instructions from the General Staff. But at the same time, the court ordered the commission to review the earlier decision on conscription “taking into account the explanations of the General Staff.”
